The Secretary of State is a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Union.
These Regulations make provision for a purpose mentioned in section 2(2) of that Act, and it appears to the Secretary of State that it is expedient for references to Annex I.A and Annex I.B to Commission Regulation (EU) No 479/2010 laying down rules for the implementation of Council Regulation (EC) No 1234/2007 as regards Member States' notifications to the Commission in the milk and milk products sector(3) to be construed as references to those provisions as amended from time to time.
The Secretary of State makes the following Regulations in exercise of the powers conferred by section 2(2) of, and paragraph 1A of Schedule 2 to, the European Communities Act 1972(4).
1.-(1) These Regulations may be cited as the Reporting of Prices of Milk Products (England) (Amendment) Regulations 2011, and come into force on 21st March 2011.
(2) These Regulations apply in England.
2.-(1) The Reporting of Prices of Milk Products (England) Regulations 2008(5) are amended as follows.
(2) In regulation 2 (interpretation)-
(a)for the definition of "Commission Regulation" substitute-
""Commission Regulation" means Commission Regulation (EU) No 479/2010 laying down rules for the implementation of Council Regulation (EC) No 1234/2007 as regards Member States' notifications to the Commission in the milk and milk products sector, and any reference to Annex I.A and Annex I.B to the Commission Regulation means Annex I.A and Annex I.B to the Commission Regulation as amended from time to time;"; and
(b)for the definition of "milk products" substitute-
""milk products" means those products specified in Article 2(3)(a) of, and Annexes I.A and I.B to, the Commission Regulation.".
(3) In regulation 3 (provision of information on prices of milk products) in paragraph (1) for "Article 6" substitute "Articles 2 and 3".

These Regulations amend the Reporting of Prices of Milk Products (England) Regulations 2008, S.I. 2008/1428, to refer to Commission Regulation (EU) No 479/2010 laying down rules for the implementation of Council Regulation (EC) No 1234/2007 as regards Member States' notifications to the Commission in the milk and milk products sector (OJ No L 135, 2.6.2010, p 26), which has replaced the Commission Regulation previously referred to in those Regulations.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
S.I. 1972/1811. The functions of the Minister of Agriculture, Fisheries and Food were transferred to the Secretary of State by the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794).
