The Secretary of State makes the following Regulations in exercise of the power conferred by section 171ZEE(2) of the Social Security Contributions and Benefits Act 1992(1) and after agreement by the Social Security Advisory Committee that the proposals in respect of these Regulations shall not be referred to it(2).
1. These Regulations may be cited as the Additional Statutory Paternity Pay (General) (Amendment) Regulations 2011 and shall come into force on 1st April 2011.
2. In regulation 14 of the Additional Statutory Paternity Pay (General) Regulations 2010(3) (additional statutory paternity pay period (adoption)), in paragraph (1), for "before" substitute "after".

These Regulations, issued free of charge, amend the Additional Statutory Paternity Pay (General) Regulations 2010 ("the Principal Regulations") to correct a drafting error in regulation 14 of those Regulations. The error concerns the date of the beginning of the additional statutory paternity pay period (adoption).
An impact assessment has not been prepared for these Regulations since they have the same effect on the costs to business and the voluntary sector as the Principal Regulations. A copy of the impact assessment for the Principal Regulations is available from the BIS website (www.bis.gov.uk) and is published with the Explanatory Memorandum alongside the principal Regulations on www.legislation.gov.uk.
1992 c.4. Part 12ZA was inserted by section 2 of the Employment Act 2002 (c.22). Section 171ZEE was inserted into Part 12ZA by section 10 of the Work and Families Act 2006 (c.18).
Section 173(1)(b) of the Social Security Administration Act 1992 (c.5) provides that proposals in respect of regulations which would otherwise be referable to the Social Security Advisory Committee may not be so referred with the agreement of that Committee. The proposals in respect of these Regulations would otherwise be referable to that Committee by virtue of section 172(1) of that Act.
