The Secretary of State for Work and Pensions, in exercise of the powers conferred by sections 3(1)(c) and 6 of the Employers' Liability (Compulsory Insurance) Act 1969(1), makes the following Regulations.
1. These Regulations may be cited as the Employers' Liability (Compulsory Insurance) (Amendment) Regulations 2011 and shall come into force on 6th April 2011.
2. Schedule 2 to the Employers' Liability (Compulsory Insurance) Regulations 1998(2) (employers exempted from insurance), is amended as follows-
(a)in paragraph 1, for "National Assembly for Wales" in both places substitute "the Welsh Ministers"(3) and for "monies provided by that Assembly" substitute "out of the Welsh Consolidated Fund".
(b)after paragraph (15), add-
"(16) The Auditor General for Wales.
(17) The Electoral Commission.
(18) The Parliamentary Commissioner for Administration.
(19) The Health Service Commissioner for England.
(20) The National Assembly for Wales Commissioner for Standards.
(21) The Public Services Ombudsman for Wales.
(22) The Comptroller and Auditor General.
(23) The Independent Parliamentary Standards Authority".

These Regulations are made under the Employers' Liability (Compulsory Insurance) Act 1969. They amend the Employers' Liability (Compulsory Insurance) Regulations 1998 by inserting new paragraphs into Schedule 2 to those Regulations. The effect of the insertions is to exempt the Auditor General for Wales, the Electoral Commission, the Parliamentary Commissioner for Administration, the Health Service Commissioner for England, the National Assembly for Wales Commissioner for Standards, the Public Services Ombudsman for Wales, the Comptroller and Auditor General and the Independent Parliamentary Standards Authority from the requirements to hold employers' liability insurance.
A full impact assessment has not been published for this instrument as it has no impact on the private sector and civil society organisations.
S.I. 1998/2573; relevant amending instruments are S.I.1999/1820, 2000/253, 2003/1615 and 2004/2882.
The functions of the National Assembly for Wales were transferred to the Welsh Ministers under section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c.32).
