The European Union (Definition of Treaties) (Partnership and Cooperation Agreement) (Republic of Indonesia) Order 2011

A draft of this Order has been laid before Parliament in accordance with section 1(3) of the European Communities Act 1972(1), and has been approved by a resolution of each House of Parliament.

Accordingly, Her Majesty, in exercise of the powers conferred on Her by section 1(3) of the European Communities Act 1972, is pleased, by and with the advice of Her Privy Council, to order as follows:

1. This Order may be cited as the European Union (Definition of Treaties) (Partnership and Cooperation Agreement) (Republic of Indonesia) Order 2011.

2. It shall come into force on the date on which the treaty specified in the Schedule enters into force for the United Kingdom. This date will be notified in the London, Edinburgh and Belfast Gazettes.

3. The treaty specified in the Schedule is to be regarded as an EU Treaty as defined in section 1(2) of the European Communities Act 1972.

SCHEDULE

The Framework Agreement on Comprehensive Partnership and Cooperation between the European Community and its Member States, of the one part, and Republic of Indonesia, of the other part, signed by the United Kingdom at Luxembourg on 26 October 2009 and by the European Community at Jakarta on 9 November 2009(2).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order declares the Framework Agreement on Comprehensive Partnership and Cooperation between the European Community and its Member States and the Republic of Indonesia, signed on 9 November 2009 to be an EU Treaty as defined in section 1(2) of the European Communities Act 1972.

This Agreement provides a framework aiming to consolidate and strengthen the European Union's and its Member States' political, economic and trade relations with the Republic of Indonesia, and promote democratic reforms, economic growth, sustainable development and action against poverty there. The Agreement will allow for further engagement between the Parties in a broad range of areas, including climate change and energy, science and technology, maritime and aviation transport. It also addresses illegal migration, money laundering and illicit drugs. In addition, the Agreement includes clauses on organised crime and corruption, human rights and combating the proliferation of weapons of mass destruction, which are treated as essential elements of the Agreement.

The principal effect of declaring this Agreement to be an EU Treaty so defined is that the provisions of section 2 of the European Communities Act 1972 apply to it.

A Regulatory Impact Assessment has not been produced for this instrument, as it has no impact on the costs to UK business, charities or voluntary bodies.
