The Secretary of State makes the following Order in exercise of the power conferred by section 38(2) of the Energy Act 2010(1):
1. This Order may be cited as the Energy Act 2010 (Commencement) Order 2012.
2. The following provisions of the Energy Act 2010 come into force on 16th July 2012-
(a)sections 18 to 23; and
(b)paragraphs 7 and 8 of the Schedule (and, so far as relating to them, paragraph 5 of the Schedule and section 35).

(This note is not part of the Order)
This Order brings into force on 16th July 2012 sections 18 to 23 of the Energy Act 2010 (which confer power on the Secretary of State to modify electricity generation licences in order to restrict or prevent licence holders from obtaining excessive benefits by the exploitation of electricity trading and transmission arrangements), and paragraphs 7 and 8 of the Schedule to that Act (which make consequential amendments to the Electricity Act 1989).
All other provisions of the Energy Act 2010 are already in force by virtue of section 38(1) and (3) of that Act.
