The Police and Crime Commissioner Elections (Designation of Local Authorities) Order 2012

Coming into force in accordance with regulation 1(2)

This Order is made by the Secretary of State in exercise of the powers conferred by section 75(1) of the Police Reform and Social Responsibility Act 2011(1).

Citation, commencement and interpretation

1.-(1) This Order may be cited as the Police and Crime Commissioner Elections (Designation of Local Authorities) Order 2012.

(2) This Order comes into force on the day after the day on which it is made.

(3) "Police area" means a police area listed in Schedule 1 to the Police Act 1996(2) (police areas outside London).

Designation of appropriate officers

2.-(1) This article designates for the purposes of section 75(1) of the Police Reform and Social Responsibility Act 2011(3) (the appropriate officer)-

(a)a local authority for each police area in England other than Lancashire and Sussex, and

(b)a local authority for each police area in Wales other than Gwent.

(2) In respect of a police area in England listed in column 1 of Schedule 1, the designated local authority is to be the local authority listed in column 2 of the Schedule opposite to the name of the police area.

(3) In respect of a police area in Wales listed in column 1 of Schedule 2, the designated local authority is to be the local authority listed in column 2 of the Schedule opposite to the name of the police area.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order makes provision in relation to England and Wales in connection with elections and vacancies affecting the office of police and crime commissioner under Chapter 6 of Part 1 of the Police Reform and Social Responsibility Act 2011 (c.13) ("the 2011 Act"). Section 75(2) of the 2011 Act provides that for each police area, other the metropolitan police district and the City of London police area, the head of paid service of the designated local authority is to be the "appropriate officer" on whom functions are conferred under Chapter 6 of Part 1.

Article 2(2) and Schedule 1 designate the local authority for each police area in England apart from Lancashire, Sussex, the metropolitan police district and the City of London police area.

Article 2(3) and Schedule 2 designate appropriate officers for police areas in Wales apart from Gwent.

(3)

Subsection (2) of section 75 of the Police Reform and Social Responsibility Act 2011 defines "appropriate officer" for the purposes of Chapter 6 of Part 1 of that Act by reference to the local authority designated under subsection (1) of that section.
