The Police and Crime Commissioner Elections (Designation of Police Area Returning Officers) (No.2) Order 2012

Coming into force in accordance with article 1(2)

This Order is made by the Secretary of State in exercise of the powers conferred by section 54(1)(b) of the Police Reform and Social Responsibility Act 2011(1).

In accordance with section 7(2)(ha) of the Political Parties, Elections and Referendums Act 2000(2), the Secretary of State has consulted the Electoral Commission.

Citation, commencement and interpretation

1.-(1) This Order may be cited as the Police and Crime Commissioner Elections (Designation of Police Area Returning Officers) (No.2) Order 2012.

(2) This Order comes into force on the day after the day on which it is made.

(3) "Police area" means a police area listed in Schedule 1 to the Police Act 1996(3) (police areas outside London).

Revocation

2. The Police and Crime Commissioner Elections (Designation of Police Area Returning Officers) Order 2012(4) is revoked.

Designation of police area returning officers

3.-(1) This article designates for the purposes of section 54(1) of the Police Reform and Social Responsibility Act 2011 (returning officers etc) the person who is to be police area returning officer for each police area in England and each police area in Wales.

(2) In respect of a police area in England listed in column 1 of Schedule 1, the police area returning officer is to be the person who is acting returning officer for the parliamentary constituency listed in column 2 of the Schedule opposite to the name of the police area (being a constituency that falls wholly or partly within the police area)(5).

(3) In respect of a police area in Wales listed in column 1 of Schedule 2, the police area returning officer is to be the person who is acting returning officer for the parliamentary constituency listed in column 2 of the Schedule opposite to the name of the police area (being a constituency that falls wholly or partly within the police area)(6).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order makes provision in relation to elections in England and Wales of police and crime commissioners under Part 1 of the Police Reform and Social Responsibility Act 2011 (c.13). It includes provision for the police areas of Lancashire, Sussex and Gwent which was omitted from the Order that is revoked by article 2 of this Order and it makes changes to designations in relation to the police areas of Suffolk and South Wales.

Article 2 revokes the Police and Crime Commissioner Elections (Designation of Police Area Returning Officers) Order 2012 (S.I. 2012/1965).

Article 3(2) and Schedule 1 designate the persons who, in an election of police and crime commissioners, are to act as the returning officer for each police area in England apart from the metropolitan police district and the City of London police area.

Article 3(3) and Schedule 2 designate the persons who are to act as the returning officer for each police area in Wales.

2000 c.41. Section 7(2)(ha) was inserted by paragraph 11 of Schedule 10 to the Police Reform and Social Responsibility Act 2011.

The person who is acting returning officer for a parliamentary constituency in England is determined by section 28(1)(a) of the Representation of the People Act 1983 (c.2) ("the 1983 Act") and by order made under section 28(1)(b) of that Act. Section 28(1)(b) was amended by paragraph 6 of Schedule 4 to the Representation of the People Act 1985 (c.50).

The person who is acting returning officer for a parliamentary constituency in Wales is determined by section 28(1)(aa) of the 1983 Act and by order made under section 28(1)(b) of that Act. Section 28(1)(aa) was inserted by paragraph 68(3) of Schedule 16 to the Local Government (Wales) Act 1994 (c.19).
