The Secretary of State for Business, Innovation and Skills makes the following Regulations in exercise of the powers conferred by sections 136(a) and (c), 145 and 210(7) of the Education Act 2002(1).
1. These Regulations may be cited as the Further Education Teachers' Qualifications (England) (Amendment) Regulations 2012 and come into force on 30th September 2012.
2. The Further Education Teachers' Qualifications (England) Regulations 2007(2) are amended as follows.
3.-(1) In regulation 2(1), omit the following definitions-
(a)"ATLS status";
(b)"IfL"; and
(c)"QTLS status".
(2) In regulation 2(2)(c), for "IfL", substitute "the Secretary of State".
4. For regulations 5 and 6, substitute-
5.-(1) Subject to the following paragraphs, no person may be employed in a full teaching role unless that person-
(a)holds the Diploma in Teaching in the Lifelong Learning Sector at Level 5 or above approved by the Secretary of State, or its equivalent; and
(b)holds a specialist's subject qualification approved by the Secretary of State, where the Secretary of State has decided that such a qualification is necessary, or its equivalent.
(2) A person who holds QTS and has satisfactorily completed an induction period in a further education institution may be employed in a full teaching role.
(3) A person who does not comply with paragraph (1) or (2) may be employed in a full teaching role for a period not exceeding 5 years.
6.-(1) Subject to the following paragraphs, no person may be employed in an associate teaching role unless that person-
(a)holds a Certificate in Teaching in the Lifelong Learning Sector at Level 3 or 4 approved by the Secretary of State or its equivalent; and
(b)holds a specialist's subject qualification approved by the Secretary of State, where the Secretary of State has decided that such a qualification is necessary, or its equivalent.
(2) A person who holds QTS and who has satisfactorily completed an induction period in a further education institution may be employed in an associate teaching role.
(3) A person who does not comply with paragraph (1) or (2) may be employed in an associate teaching role for a period not exceeding 5 years.".

These Regulations amend the Further Education Teachers' Qualifications (England) Regulations 2007. Regulation 1 removes the definitions of "IfL", "ATLS status" and "QTLS status" which has the effect of revoking the regulatory requirements for individuals to register with the Institute for Learning and other related requirements that depend on mandatory IfL registration. In particular, this will remove the requirement for teachers in full teaching roles to complete a process of professional formation to the satisfaction of the IfL and hold QTLS status; and for teachers in associate teaching roles to complete a process of professional formation to the satisfaction of the IfL.
An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen. The Explanatory Memorandum is published alongside these Regulations on www.legislation.gov.uk.
2002 c.32; section 145 was amended by paragraph 24 of Schedule 14 to the Education Act 2005 (c.18), and by paragraph 19 of Schedule 2, and paragraph 17 of Schedule 5, to the Education Act 2011 (c.21); and section 210(7) was amended by section 21(3) of the Learner Travel (Wales) Measure 2008 (c.2).
