The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 113A(6) and 125 of the Police Act 1997(1), as extended and modified by the Police Act 1997 (Criminal Records) (Isle of Man) Order 2010(2).
In accordance with article 9 of the Police Act 1997 (Criminal Records) (Isle of Man) Order 2010, the Secretary of State has consulted the Department of Home Affairs of the Isle of Man.
1.-(1) These Regulations may be cited as the Police Act 1997 (Criminal Records and Registration) (Isle of Man) (Amendment No. 2) Regulations 2012 and come into force on 19th November 2012.
(2) These Regulations extend to the Isle of Man.
2. In regulation 8 of the Police Act 1997 (Criminal Records and Registration) (Isle of Man) Regulations 2011 (central records: prescribed details)(3) for "National Policing Improvement Agency" substitute "Secretary of State".

These Regulations, which come into force on 19th November 2012, amend the Police Act 1997 (Criminal Records and Registration) (Isle of Man) Regulations 2011 ("the 2011 Regulations").
Regulation 2 amends regulation 8 of the 2011 Regulations in order to replace the reference to the National Policing Improvement Agency ("NPIA") with a reference to the Secretary of State. The NPIA is being phased out and the Home Office has now taken over the function of running the Police National Computer ("PNC"). It is the names database of convictions, cautions, warnings and reprimands which is held on the PNC which is prescribed as "central records" for the purposes of section 113A(6) of the Police Act 1997.
1997 c. 50. Section 113A was inserted by section 163(2) of the Serious Organised Crime and Police Act 2005 (c. 15). There are amendments but none relevant to these Regulations.
