Citation and commencement

1. This Order may be cited as the Registration of Civil Partnerships (Fees) (Amendment) Order 2012 and shall come into force on 1st April 2012.

Amendment of the Registration of Civil Partnerships (Fees) Order 2005

2. The Schedule to the Registration of Civil Partnerships (Fees) Order 2005(3) is amended as follows-

(a)in the entry numbered 1 (attestation by an authorised person of the necessary declaration), in the column with the heading "Fee", for "£33.50" substitute "£35.00";

(b)in the entry numbered 2 (attendance of an authorised person at a place other than one provided by the registration authority etc), in the column with the heading "Fee", for "£49.00" substitute "£46.00 for house-bound" and "£67.00 for detained";

(c)in the entry numbered 6 (signing by the civil partnership registrar of the civil partnership schedule), in the column with the heading "Fee", for "£40.00" substitute "£45.00"; and

(d)in the entry numbered 7 (attendance of the civil partnership registrar for the purpose of signing the civil partnership schedule etc), in the column with the heading "Fee", for "£80.00" substitute "£79.00" for house-bound" and "£86.00" for detained".

Amendment of the Registration of Civil Partnerships (Fees) (No. 2) Order 2005

3. The Schedule to the Registration of Civil Partnerships (Fees) (No.2) Order 2005(4) is amended as follows-

(a)in the entry numbered 3(a) (certified copy issued by a registration authority at the time of the formation of the civil partnership), in the column with the heading "Fee", for "£3.50" substitute "£4.00";

(b)in the entry numbered 3(b) (certified copy issued by a registration authority in any case other than at the time of the formation of the civil partnership), in the column with the heading "Fee", for "£9.00" substitute "£10.00";

(c)in the entry numbered 4(a) (certified extract issued by a registration authority at the time of the formation of the civil partnership), in the column with the heading "Fee", for "£3.50" substitute "£4.00";

(d)in the entry numbered 4(b) (certified extract issued by a registration authority in any case other than at the time of the formation of the civil partnership), in the column with the heading "Fee", for "£9.00" substitute "£10.00"; and

(e)in the entry numbered 6 (giving notice to a registration authority under article 17(2) of the Civil Partnership (Registration Abroad and Certificates) Order 2005(5) etc), in the column with the heading "Fee", for "£33.50" substitute "£35.00".

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Registration of Civil Partnerships (Fees) Order 2005 and the Registration of Civil Partnerships (Fees) (No. 2) Order 2005 by amending some of the fees payable in relation to the registration of civil partnerships from 1st April 2012.

The fees specified by the Registration of Civil Partnerships (Fees) Order 2005 and which are amended by this Order are those:

(a)for the attestation by an authorised person of the necessary declaration (from £33.50 to £35.00);

(b)for the attendance of an authorised person at a place other than one provided by the registration authority etc. (from £49.00 for house-bound or detained to £46.00 for house-bound and £67.00 for detained);

(c)for the signing by the civil partnership registrar of the civil partnership schedule (from £40.00 to £45.00); and

(d)for the attendance of the civil partnership registrar for the purpose of signing the civil partnership schedule etc. (from £80.00 for house-bound or detained to £79.00 for house-bound and £86.00 for detained).

The fees specified by the Registration of Civil Partnerships (Fees) (No. 2) Order 2005 and which are increased by this Order are those:

(a)for a certified copy issued by a registration authority at the time of the formation of the civil partnership (from £3.50 to £4.00);

(b)for a certified copy issued by a registration authority in any case other than at the time of the formation of the civil partnership (from £9.00 to £10.00);

(c)for a certified extract issued by a registration authority at the time of the formation of the civil partnership (from £3.50 to £4.00);

(d)for a certified extract issued by a registration authority in any case other than at the time of the formation of the civil partnership (from £9.00 to £10.00); and

(e)for giving notice to a registration authority under article 17(2) of the Civil Partnership (Registration Abroad and Certificates) Order 2005 etc. (from £33.50 to £35.00).

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
