The National Health Service (General Duties of the National Health Service Commissioning Board in Relation to Clinical Commissioning Groups - Specification of Date) Order 2013

The Secretary of State makes the following Order in exercise of the power conferred by section 14A(1) of the National Health Service Act 2006(1).

Citation

1. This Order may be cited as the National Health Service (General Duties of the National Health Service Commissioning Board in Relation to Clinical Commissioning Groups -Specification of Date) Order 2013.

Specified day

2. For the purposes of section 14A of the National Health Service Act 2006 the day specified is the 31st March 2013.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is made under section 14A(1) of the National Health Service Act 2006 ("the 2006 Act") as inserted by section 25(1) of the Health and Social Care Act 2012 ("the 2012 Act").

Section 14A(1) of the 2006 Act imposes a duty on the National Health Service Commissioning Board ("the Board"), to ensure that at any time after a day specified by order of the Secretary of State each provider of primary medical services (see section 14A(3) and (4) of the 2006 Act and regulation 2 of the National Health Service (Clinical Commissioning Groups) Regulations 2012 S.I 2012/1631 for the definition of "provider of primary medical services"), is a member of a clinical commissioning group ("CCG").

Section 14A(2) of the 2006 Act imposes a duty on the Board to ensure that at any time after a day specified by order of the Secretary of State the areas that are specified in the constitutions of CCGs taken together cover the whole of England and do not coincide or overlap.

Article 2 of this Order specifies 31st March 2013 for these purposes.

An impact assessment has not been produced for this instrument as the Order itself has no impact on the private sector or civil society organisations.
