The Secretary of State makes the following Order in exercise of the powers conferred by section 5C(1) of the Sustainable Communities Act 2007(1) and after having consulted-
(a)local authorities;
(b)such other persons who represent the interests of local authorities as the Secretary of State thought fit; and
(c)the class of persons whom the Secretary of State specifies in this Order,
in accordance with section 5C(2) of that Act.
1. This Order may be cited as the Sustainable Communities (Parish Councils) Order 2013 and comes into force on 14th October 2013.
2. For the purposes of section 5C(1) of the Sustainable Communities Act 2007, parish councils are specified as a class of persons, in addition to local authorities(2), who may make proposals on or after 14th October 2013.

The Sustainable Communities Act 2007 provides for invitations to be made by the Secretary of State to local authorities for proposals to contribute to promoting the sustainability of local communities. Article 2 of this Order specifies parish councils (which includes town councils) as another class of person who can make such proposals.
An impact assessment has not been produced for this instrument as no impact on business or the private or voluntary sectors is foreseen and the impact on the public sector is minimal.
