The Secretary of State for Education makes the following Order in exercise of the power conferred by section 44(4) of the Children and Young Persons Act 2008:

Citation

1.  This Order may be cited as the Children and Young Persons Act 2008 (Commencement No. 5) (England) Order 2013.

Appointed day

2.  12th November 2013 is the appointed day for the coming into force in England of the following sections of the Children and Young Persons Act 2008 ("the Act")(1)-

(a)section 1 of the Act insofar as it is not already in force (power to enter into arrangements for discharge of care functions), and

(b)section 4 of the Act (regulation of providers of social work services).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is the fifth Commencement Order made by the Secretary of State under the Children and Young Persons Act 2008 ("the Act") which brings provisions of the Act into force only in relation to England.

Article 2 brings section 1 fully into force on 12th November 2013. Section 1 provides that a local authority may enter into arrangements with a provider of social work services for the discharge by that provider of some or all of the relevant care functions of that authority. Section 1 was commenced in relation to six local authorities on 16th February 2009, ten local authorities on 16th December 2010 and a further four local authorities on 14th November 2011. Article 2 also commences section 4 of the Act which provides that the Care Standards Act 2000 applies to a provider of social work services as it applies to an agency under that Act.
