The Secretary of State for Education, in exercise of the powers conferred by sections 19(3) and 210(7) of the Education Act 2002(1), makes the following Regulations:
1. These Regulations may be cited as the School Governance (Roles, Procedures and Allowances) (England) (Amendment) Regulations 2013 and come into force on 14th November 2013.
2. (1) The School Governance (Roles, Procedures and Allowances) (England) Regulations 2013(2) are amended as follows.
(2) In regulation 13-
(a)in paragraph (4) for "and a copy of the agenda for the meeting" substitute ", a copy of the agenda for the meeting and any reports or other papers to be considered at the meeting";
(b)in paragraph (5) for "the notice and the copy of the agenda" substitute "the notice, copy of the agenda and any reports or other papers to be considered".
(3) In regulation 26(2)-
(a)omit "and" at the end of sub-paragraph (a);
(b)at the end of sub-paragraph (b) insert "and";
(c)after sub-paragraph (b) insert "(c) any reports or other papers to be considered at the meeting"; and
(d)for "the notice and agenda" substitute "the notice, copy of the agenda and any reports or other papers to be considered".
3. In regulation 26, after paragraph (9) insert-
"(10) Notwithstanding the requirements of regulation 22(2) and of paragraphs (4) and (5) of this regulation, the governing body may approve alternative arrangements for committee members to participate or vote at meetings of a committee including but not limited to by telephone or video conference."

These Regulations amend the School Governance (Roles, Procedures and Allowances) (England) Regulations 2013 (the "2013 Regulations"), which came into force on 1st September 2013.
The amendment at Regulation 2 re-introduces a requirement that reports or other papers to be considered at meetings of governing bodies and meetings of committees of governing bodies are circulated seven days in advance of such meetings. This requirement was contained in the School Governance (Procedures) (England) Regulations 2003 that were revoked by the 2013 Regulations.
The amendment at Regulation 3 provides that governing bodies may approve alternative arrangements for members of committees of governing bodies to participate or vote at meetings of the committee, including but not limited to by telephone or video conference.
A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen since the net impact is to reduce burdens and constraints on governing bodies, and it will not impose any additional cost or increase the workload for schools or local authorities.
