The Secretary of State makes the following Regulations in exercise of the powers conferred by section 57 of the Vehicle Excise and Registration Act 1994(1) as extended by section 156 of the Road Traffic Act 1988(2).
In accordance with section 195(2) of the Road Traffic Act 1988, the Secretary of State has consulted with representative organisations.
1. (1) These Regulations may be cited as the Motor Vehicles (Third Party Risks) (Amendment) Regulations 2013 and come into force on 16th December 2013.
(2) These Regulations extend to Great Britain(3).
2. Regulation 9 (production of evidence of insurance or security on application for excise licences) of the Motor Vehicles (Third Party Risks) Regulations 1972(4) is omitted.
3. Regulation 8 (production of insurance card on application for excise licence) of the Motor Vehicles (International Motor Insurance Card) Regulations 1971(5) is omitted.

These Regulations amend the Motor Vehicles (Third Party Risks) Regulations 1972 to remove the requirement to produce evidence of motor insurance or comparable surety when applying for a vehicle excise licence. This requirement is set out in regulation 9(1) of the Motor Vehicles (Third Party Risks) Regulations 1972, and exceptions to it are set out in regulations 9(2), 9(3) and 9(4).
Regulation 9 is subject to regulation 8 of the Motor Vehicles (International Motor Insurance Card) Regulations 1971 which allows holders of green cards (visitors to Great Britain) to provide a green card as proof of valid insurance as an alternative to the requirements of regulation 9. Both provisions are omitted because regular checks for valid motor insurance are made under the continuous insurance enforcement scheme.

1994 c.22; section 57 was amended by the Finance Act 1996 (c.8), Schedule 2, paragraph 16; and by the Finance Act 2002 (c.23), Schedule 5, paragraphs 1 and 16, and Schedule 40, Part 1(5).
1988 c.52; section 156 was amended by paragraph 24(5) of Schedule 3 to the Vehicle Excise and Registration Act 1994.
The Motor Vehicles (Third Party Risks) Regulations 1972 and the Motor Vehicles (International Motor Insurance Card) Regulations 1971 extend to Great Britain and now take effect under sections 57, 67 and Schedule 4 of the Vehicle Excise and Registration Act 1994 and sections 147, 156, 160 and 197(3) of the Road Traffic Act 1988.
