The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by sections 36(3) and 118(5) of the Care Standards Act 2000(1).
1. These Regulations may be cited as the Care Standards Act 2000 (Registration) (England) (Amendment) Regulations 2013 and come into force on 1st April 2013.
2.-(1) Regulation 7 (registers) of the Care Standards Act 2000 (Registration) (England) Regulations 2010(2) is amended as follows.
(2) For paragraph (5) substitute-
"(5) Subject to paragraph (6), subsections (1) and (2) of section 36 of the Act do not apply to those parts of the register listed in paragraphs 1, 2, 3 or 10 of Schedule 5 and any inspection report in that register shall not contain the name and address of the children's home or any other information by which the children's home could be identified.".
(3) After paragraph (5) insert-
"(6) Paragraph (5) does not apply in the case of a request to inspect the register, or for any of the information set out in that paragraph, made by:
(a)the Secretary of State for Education;
(b)a local authority;
(c)the chief officer of police for any police area in England for the purposes of safeguarding the welfare of children accommodated in children's homes within that area; and
(d)the office of the Children's Commissioner.".

Regulation 7 of the Care Standards Act 2000 (Registration) (England) Regulations 2010 prohibited Her Majesty's Chief Inspector of Education, Children's Services and Skills from disclosing, under section 36 of the Care Standards Act 2000, certain parts of the register in respect of a children's home to any person other than a local authority. These Regulations amend regulation 7 with the effect that the Chief Inspector will also be required to disclose all parts of the register to the Secretary of State for Education, the chief officer of police and the office of the Children's Commissioner if those persons request that disclosure under section 36 of the Care Standards Act 2000.
An impact assessment has not been prepared for these Regulations as no impact on businesses or civil society organisations is foreseen.
