The Secretary of State for Health makes the following Order in exercise of the powers conferred by sections 213, 217(2) and 272(7) and (8) of the National Health Service Act 2006(1), having regard to changes in the functions of the Oxford University Hospitals National Health Service Trust.
1. (1) This Order may be cited as the Oxford Health NHS Foundation Trust (Transfer of Trust Property) Order 2014 and comes into force on 14th July 2014.
(2) In this Order-
"the trustees" means the trustees appointed for the Oxford University Hospitals National Health Service Trust(2);
"the old Trust" means the Oxford Health NHS Foundation Trust(3);
"the trust property" means the property specified in the schedule of trust property prepared and agreed by the old Trust and the trustees and signed on behalf of the old Trust on 15th May 2014 and the trustees on 10th May 2014.
2. (1) On the date that this Order comes into force the trust property, and any rights and liabilities arising from that property, are transferred from the old Trust to the trustees.
(2) Following the transfer in paragraph (1), in any instrument relating to the trust property, any reference to the trustees of the trust property or to the old Trust is to be construed as a reference to the trustees.

This Order transfers to the trustees appointed for the Oxford University Hospitals National Health Service Trust property held on trust by the Oxford Health NHS Foundation Trust and makes related provision. Copies of the schedule of trust property transferred under this Order can be obtained from the Department of Health, Quarry House, Quarry Hill, Leeds LS2 7UE.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
2006 c. 41. Section 213 was amended by section 55(1) of, and paragraph 109 of Schedule 4 to, the Health and Social Care Act 2012 (c. 7) (the "2012 Act"). Section 217 was amended by section 354(1) of, and paragraph 111 of Schedule 7 to, the Charities Act 2011 (c. 25) and by section 55(1) of, and paragraph 113 of Schedule 4 to, the 2012 Act.
Established by S.I. 1993/2544, amended by S.I. 1994/482 (which changed the name of the trust from the Churchill John Radcliffe National Health Service Trust to the Oxford Radcliffe Hospital National Health Service Trust), S.I. 1998/1227 (which changed the name of the trust to the Oxford Radcliffe Hospitals National Health Service Trust), S.I. 2000/961, S.I. 2011/2397 (which, amongst other things, changed the name of the trust to the Oxford University Hospitals National Health Service Trust) and S.I. 2013/593. See S.I. 2003/1093 which provided for the appointment of trustees to the NHS trust.
