The Secretary of State for Communities and Local Government, in exercise of the powers conferred by sections 3(3), 30 and 146(1) and (2) of the Housing Grants, Construction and Regeneration Act 1996(1), and with the consent of the Treasury, makes the following Regulations:
1. These Regulations may be cited as the Housing Renewal Grants (Amendment) (England) Regulations 2014 and shall come into force on 13th August 2014.
2. These Regulations apply to applications for grants which fall to be approved on or after 13th August by local housing authorities in England.
3. The Housing Renewal Grants Regulations 1996(2) are amended as follows:
(1) In regulation 19(9B)(a)(iv) after "…section 35" insert "or 35B".

Regulation 3(1) of these Regulations amends regulation 19(9B)(a)(vi) of the Housing Renewal Grants Regulations 1996 (S.I. 1996/2367) to incorporate a reference to section 35B of the Social Security Contributions and Benefits Act 1992 (c.4). Section 35B provides for maternity allowance for woman who participate in the work of their self-employed spouse or civil partner, which participation is not remunerated. Maternity allowance falls to be considered as relevant income when awarding a grant under the Housing Renewal Grants Regulations 1996.
Section 35B was inserted into the Social Security Contributions and Benefits Act 1992 by the Social Security (Maternity Allowance) (Participating Wife or Civil Partner or Self-Employed Earner) Regulations 2014 (S.I ) which implemented Directive 2010/41/EU (on the application of the principle of equal treatment between men and women engaged in an activity in a self/-employed capacity and repealing Council Directive 86/613/EEC). (OJ L 180 15.7.2010 p.1).
An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
1996 c. 53. The functions of the Secretary of State under these sections were, so far as excersiable in relation to Wales, transferred to the National Assembly for Wales by Article 2 and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) to which there have been amendments made not relevant to these regulations. Section 30 was amended by Article 11 of and Schedule 3 to the Regulatory Reform (Housing Assistance) (England and Wales) Order 2002 (S.I. 2002/1860).
