The Secretary of State, in exercise of the powers conferred by sections 29 and 37(2)(c) of the Borders, Citizenship and Immigration Act 2009(1), makes the following Regulations:
1. These Regulations may be cited as the Customs (Inspections by Her Majesty's Inspectors of Constabulary and the Scottish Inspectors) (Amendment) Regulations 2014 and shall come into force on 1st May 2014.
2. In these Regulations, "the 2012 Regulations" means the Customs (Inspections by Her Majesty's Inspectors of Constabulary and the Scottish Inspectors) Regulations 2012(2).
3. The 2012 Regulations shall be amended in accordance with regulations 4 and 5.
4. (1) In regulation 6(1) of the 2012 Regulations, for the words "another public authority", substitute "Her Majesty's Inspectorate of Prisons".
(2) Omit regulation 6(3) of the 2012 Regulations.
5. In Part 1 of the Schedule to the 2012 Regulations-
(a)for "Customs Spine Suite, Gatwick Airport, Concorde 2000 South Wing, Gatwick Airport, Crawley, West Sussex RH6 0LX" substitute "UKBF Custody Suite, Ground Floor, Ashdown House, East Perimeter Road, Gatwick, Horley, Sussex, RH6 0LX";
(b)omit "Customs Interview Suite, Luton Airport, Terminal Building, Luton, Bedfordshire, LU2 9NJ".

These Regulations amend the Customs (Inspections by Her Majesty's Inspectors of Constabulary and the Scottish Inspectors) Regulations 2012(3).
Regulation 4 amends regulation 6 of the 2012 Regulations, which provides for the delegation of their functions by Her Majesty's Inspectors of Constabulary, to remove the ability to delegate to a public body other than Her Majesty's Inspectorate of Prisons.
Regulation 5 amends Part 1 of the Schedule to the 2012 Regulations to provide for changes in the locations of customs detention premises in England and Wales since the 2012 Regulations. Her Majesty's Inspectors of Constabulary have the power to inspect and report on the efficiency and effectiveness of the exercise of specified functions by customs officials or contractors, where that conduct takes place at one or more of the customs detention premises listed in the Schedule, or in a vehicle used to transport a person to or from those premises, in England and Wales.
