The Protection of Freedoms Act 2012 (Commencement No.11) Order 2015

The Secretary of State, in exercise of the powers conferred by sections 120(1) of the Protection of Freedoms Act 2012(1), makes the following Order:

Citation

1.  This Order may be cited as the Protection of Freedoms Act 2012 (Commencement No.11) Order 2015.

Commencement

2.  The following provisions of the Protection of Freedoms Act 2012 come into force on 16th March 2015-

(a)section 105 (appointment and tenure of the Information Commissioner);

(b)section 115(2) in so far as it relates to the provisions of Schedule 10 to that Act specified in paragraph (c) below; and

(c)Part 8 of Schedule 10 (repeals and revocations) in so far as it repeals paragraph 2(4) and (5) of Schedule 5 to the Data Protection Act 1998(2) and section 18(5) to (7) of the Freedom of Information Act 2000(3).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force section 105 of the Protection of Freedoms Act 2012 (‘the 2012 Act') on 16th March 2015. Section 105 of the 2012 Act makes provision relating to the appointment and tenure of the Information Commissioner. In particular, section 105 of the 2012 Act increases the maximum term of appointment for an Information Commissioner from 5 years to 7 years, amends the procedure for removing an Information Commissioner from office, and prohibits the re-appointment of an Information Commissioner for a further term of office. The Order also commences minor consequential repeals relating to section 105 of the 2012 Act and commences the repeal of spent transitional provisions in section 18 of the Freedom of Information Act 2000.
