The Secretary of State for Education, in exercise of the powers conferred by sections 26(3) and 47 of the Higher Education Act 2004(1), makes the following Regulations.

Citation, commencement and application

1.-(1) These Regulations may be cited as the Student Fees (Inflation Index) (England) (Amendment) Regulations 2016 and come into force on 6th January 2017.

(2) These Regulations apply to England.

Index of Prices

2.  In regulation 2 of the Student Fees (Inflation Index) Regulations 2006(2) for "the Office of National Statistics" substitute "the Office for Budget Responsibility".

EXPLANATORY NOTE

(This note is not part of the Regulations)

Sections 26(3) and 47 of the Higher Education Act 2004(3) enable the Secretary of State to specify an index to which she is to have regard in deciding whether any increase in the basic or higher tuition fee amounts is no greater than required to maintain the value of the amounts in real terms.

Regulation 2 of these Regulations amends regulation 2 of Student Fees (Inflation Index) Regulations 2006(4), which specifies the All Items Retail Prices Index Excluding Mortgage Interest Repayments, to clarify that this index is now published by the Office for Budget Responsibility, rather than the Office for National Statistics.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
