The Civil Enforcement of Parking Contraventions Designation and Consequential Amendment Order 2017

This Order is made in exercise of powers conferred by paragraph 8(1) of Schedule 8, and paragraph 3(1) of Schedule 10, to the Traffic Management Act 2004(1) ("the 2004 Act").

North Somerset District Council has applied to the Secretary of State for an order to be made in exercise of those powers, in respect of part of that council's area.

The Buckinghamshire County Council has applied to the Secretary of State for an order to be made in exercise of those powers, in respect of part of that council's area.

In accordance with the requirements of paragraph 8(3) of Schedule 8, and paragraph 3(4) of Schedule 10, to the 2004 Act, the Secretary of State has consulted the chief officers of police of the Avon and Somerset Police and Thames Valley Police.

Accordingly, the Secretary of State(2) makes this Order.

Citation and commencement

1.  This Order may be cited as the Civil Enforcement of Parking Contraventions Designation and Consequential Amendment Order 2017 and comes into force on 3rd April 2017.

Designation of civil enforcement areas and special enforcement areas under the Traffic Management Act 2004

2.-(1) The Secretary of State designates each of the areas described in paragraph (2) as-

(a)a civil enforcement area for parking contraventions; and

(b)a special enforcement area.

(2) The areas are-

(a)the part of the area of North Somerset District Council specified in Schedule 1; and

(b)the part of the area of The Buckinghamshire County Council specified in Schedule 2.

Amendment of Order

3.-(1) The Bus Lane Contraventions (Approved Local Authorities) (England) (Amendment) and Civil Enforcement of Parking Contraventions Designation (No. 2) Order 2012(3) is amended as follows.

(2) Omit paragraph (e) of Schedule 1.

Article 2(2)(a)

SCHEDULE 1The part of the area of North Somerset District Council designated as a civil enforcement area for parking contraventions and as a special enforcement area

The whole of the area of North Somerset District Council except -

(a)the southbound and northbound carriageways of the M5 Motorway, including its slip roads, from the administrative boundary with Bristol City Council at Ordnance Survey national grid reference point ST5193576830 to the administrative boundary with Somerset County Council at Ordnance Survey national grid reference point ST3751655003;

(b)the roads forming the perimeter to Bristol International Airport which comprise the following-

(i)the A38 from its junction with Downside Road at Ordnance Survey national grid reference point ST5135965641 to a point at Ordnance Survey national grid reference point ST5076364320;

(ii)Downside Road from its junction with the A38 at Ordnance Survey national grid reference point ST5134565636 to a point at Ordnance Survey national grid reference point ST4984565940;

(iii)Cooks Bridle Path from its junction with Downside Road at Ordnance Survey national grid reference point ST4984965934 to its junction with Winters Lane at Ordnance Survey national grid reference point ST4969665312;

(iv)Winters Lane from its junction with Cooks Bridle Path at Ordnance Survey national grid reference point ST4969665312 to a point at Ordnance Survey national grid reference point ST4958164827; and

(v)the entire length of the Bristol Road spur leading from its junction with the A38 at the roundabout providing access to the northern side of the airport at Ordnance Survey national grid reference point ST5128965424 to Ordnance Survey national grid reference point ST5130365477;

(c)the part situated within the boundary of the Link Road Car Park at Ordnance Survey national grid reference point ST4748870853.

Article 2(2)(b)

SCHEDULE 2The part of the area of The Buckinghamshire County Council designated as a civil enforcement area for parking contraventions and as a special enforcement area

The part of the area of South Bucks District Council(4) comprising all off-street parking places provided by South Bucks District Council pursuant to section 32(1)(a) of the Road Traffic Regulation Act 1984 (power of local authorities to provide off-street parking places)(5).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates parts of the area of each of North Somerset District Council and The Buckinghamshire County Council as a civil enforcement area for parking contraventions and as a special enforcement area for the purposes of Part 6 of the Traffic Management Act 2004 (c. 18).

The part of the area of The Buckinghamshire County Council so designated comprises all off-street parking places provided by South Bucks District Council under section 32(1)(a) of the Road Traffic Regulation Act 1984 (c.27). Accordingly, article 3 makes a consequential amendment to a designation contained in an earlier order to remove those off-street parking places from the exception to that designation.

An impact assessment has not been produced as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum is available alongside the instrument on the UK legislation website, www.legislation.gov.uk.

The Secretary of State is, by virtue of section 92 of the Traffic Management Act 2004, the ‘appropriate national authority' as regards England for the purposes of Part 6 of that Act.

South Bucks District Council changed its name from Beaconsfield District Council by a Notice of Motion on 1st April 1980.
