The General Osteopathic Council has made the General Osteopathic Council (Continuing Professional Development) (Amendment) Rules 2018, which are set out in the Schedule to this Order, in exercise of the powers conferred by sections 6(2) and (3), 17 and 35(2) of, and paragraph 15(1) of the Schedule to, the Osteopaths Act 1993(1).
The General Osteopathic Council has consulted in accordance with section 17(3) of that Act.
By virtue of sections 35(1) and 36(1) of the Osteopaths Act 1993, such Rules shall not come into force until approved by order of the Privy Council.
1. This Order may be cited as the General Osteopathic Council (Continuing Professional Development) (Amendment) Rules Order of Council 2018 and comes into force on 1st October 2018.
2. Their Lordships, having taken the Rules contained in the Schedule into consideration, are pleased to, and do approve them.

Article 2
The General Osteopathic Council makes the following Rules in exercise of its powers under sections 6(2) and (3), 17 and 35(2) of, and paragraph 15(1) of the Schedule to, the Osteopaths Act 1993(2).
The General Osteopathic Council has consulted in accordance with section 17(3) of that Act.
1.-(1) These Rules may be cited as the General Osteopathic Council (Continuing Professional Development) (Amendment) Rules 2018 and shall come into force on 1st October 2018.
(2) In these Rules "the Principal Rules" means the General Osteopathic Council (Continuing Professional Development) Rules 2006(3).
2.-(1) Rule 2 (interpretation) of the Principal Rules is amended as follows.
(2) In the definition of "CPD"-
(a)substitute "training which comprises" with "continuing professional development and includes";
(b)after "individual study" insert ", peer discussion review".
(3) In the definition of "CPD end date"-
(a)before "renewal date" where it first appears insert "third annual";
(b)for "if an osteopath's renewal date is 9th June, his CPD end date is 31st March" substitute "if an osteopath is first registered on 9th June, his CPD end date is 31st March three years after".
(4) In the definition of "CPD period" for "means a CPD year, the first CPD year or the transitional CPD year" substitute "means the first CPD period or a later three year CPD period".
(5) In the definition of "learning with others" after paragraph (b) insert-
"(c)for the first CPD period and any later three year CPD periods, must include a peer discussion review;".
(6) At the appropriate place in the alphabetical order insert-
""CPD guidance" means CPD guidance issued by the General Council in accordance with rule 4(6);";
""peer discussion review" means the review of an osteopath's CPD by means of a discussion with a peer reviewer which forms part of an osteopath's CPD requirement under rule 4;".
3. For rule 3 (CPD year, first CPD year and transitional CPD year: definitions) of the Principal Rules, substitute-
3.-(1) Paragraph (2) applies to an osteopath whose name is first registered or restored to the register on or after 1st October 2018.
(2) In relation to an osteopath to whom this paragraph applies-
(a)the first CPD period is the period beginning with the date on which his name was registered or restored to the register, and ending on the next CPD end date (in these Rules referred to as "the first CPD period"); and
(b)any subsequent CPD period is a period of three years starting on the day immediately following the day on which his preceding CPD period ended and ending on the CPD end date (in these Rules referred to as "a later three year CPD period").
(3) Paragraph (4) applies to an osteopath whose name is already registered on 1st October 2018.
(4) In relation to an osteopath to whom this paragraph applies that osteopath's CPD period is a period of three years starting on the day immediately following the day on which his preceding CPD period ends and ending on the CPD end date (in these Rules referred to as "a later three year CPD period").".
4.-(1) Rule 4 (CPD requirement for osteopaths) of the Principal Rules is amended as follows.
(2) For paragraphs (2) and (3) substitute-
"(2) The CPD requirement for a later three year CPD period consists of the completion of at least 90 hours of CPD and at least 45 hours of which must involve participation in learning with others, including the satisfactory completion of a peer discussion review.
(3) The CPD requirement for the first CPD period consists of the completion of at least two and a half hours of CPD for each whole month of that period and at least one and a quarter of those hours for each such month must involve participation in learning with others, including the satisfactory completion of a peer discussion review.".
(3) Omit paragraph (4).
(4) After paragraph (5) insert-
"(6) The General Council must issue CPD guidance indicating how the CPD requirement may be satisfied, which may include:
(a)any relevant standard to be taken into account;
(b)the aim and content of the peer discussion review, including such matters as-
(i)the characteristics of any individual selected by an osteopath to perform the peer discussion review,
(ii)the matters to be discussed and recorded as part of the peer discussion review, and
(iii)the timing of the review in relation to an osteopath's CPD end date; and
(c)any other information which may help to demonstrate that an osteopath has met the CPD requirement.
(7) Before issuing CPD guidance, the General Council must take such steps as are reasonably practicable to consult osteopaths and such other persons and organisations as it considers appropriate.".
5. Omit rule 5 (exemption from CPD requirement (newly registered osteopaths)) of the Principal Rules.
6.-(1) Rule 9 (summary form) of the Principal Rules is amended as follows.
(2) In the heading, substitute "Summary" with "CPD".
(3) For paragraphs (1) and (2) substitute-
"(1) The Registrar must send to every osteopath prior to the end of the osteopath's CPD period-
(a)a form to be completed in accordance with paragraph (2) ("a CPD form");
(b)a notice requiring the osteopath to deliver to the Registrar the CPD form, completed in accordance with paragraph (2), before the end of the period of 28 days beginning with the day on which the osteopath's CPD period ends ("the return date"); and
(c)a warning that if the osteopath fails to-
(i)satisfy the CPD requirement under rule 4,
(ii)complete the CPD form to the satisfaction of the Registrar, including the provision of the information specified in paragraph (2), or
(iii)deliver that CPD form to the Registrar by the return date,
the osteopath's name may be removed from the register.
(2) In completing the CPD form, the osteopath must-
(a)state the total number of CPD hours completed by the osteopath during the CPD period and in addition specify the number of CPD hours involving the osteopath in learning with others;
(b)confirm the successful completion of the CPD requirement as specified in rule 4;
(c)provide such other details as the Registrar may require; and
(d)sign and date the form.".
(4) In paragraph (3) for "summary form" in each place it occurs, substitute "CPD form".
7.-(1) Rule 10 (removal from the register) of the Principal Rules is amended as follows.
(2) For "summary form" in each place it occurs substitute "CPD form".
(3) In paragraphs (3) and (4) omit "hours".
8.-(1) Rule 15 (sending of notices) of the Principal Rules is amended as follows.
(2) For "form" in each place it occurs substitute "CPD form".
9.-(1) In this rule-
"the unamended rules" means the General Osteopathic Council (Continuing Professional Development) Rules 2006 as in force immediately before 1st October 2018;
"CPD period" has the meaning given in rule 2 of the unamended rules.
(2) Where an osteopath's name is already registered on 1st October 2018, the unamended rules are to apply in respect of that osteopath until the end of the osteopath's current CPD period.

The Rules contained in the Schedule to this Order amend the General Osteopathic Council (Continuing Professional Development) Rules 2006 as set out in the Schedule to the General Osteopathic Council (Continuing Professional Development) Rules Order of Council 2006 (S.I. 2006/3511) which set out the requirements in respect of post registration training which have to be met by registered osteopaths.
Rule 2 is amended to widen the definition of continuing professional development, to define the relevant dates for osteopaths to comply with the continuing professional development requirement and to include in the definition of "learning with others" a requirement to include a peer discussion review. Rule 2 is also amended to include a definition of "peer discussion review" and a definition of "CPD guidance".
Rule 3 is substituted by a new rule 3 which extends the period in which an osteopath is required to complete the continuing professional development requirement from one year to three years.
Rule 4 is amended to give effect to the new requirements for continuing professional development that need to be completed within the CPD periods as set out in rule 3.
Rule 5 is deleted to remove the exemption from continuing professional development for newly qualified osteopaths.
Rule 9 is amended to include the requirement that, when sending a CPD form to the osteopath prior to the end of an osteopath's CPD period, the Registrar must warn the osteopath that a failure to satisfy the CPD requirement under rule 4 may result in the removal of the osteopath's name from the register. It also includes the new requirement for the osteopath to confirm in the CPD form that the osteopath has completed the CPD requirement as required under rule 4.
Rules 10 and 15 are amended in consequence of the amendments to rule 9.
Rule 9 of these Rules makes transitional and saving provision in respect of osteopaths who are already on the register on 1st October 2018.
