The Secretary of State, in exercise of the powers conferred by sections 29(2)(c) and (7)(b) and 43(8) of the Regulation of Investigatory Powers Act 2000(1), makes the following Order.

Citation and commencement

1.  This Order may be cited as the Regulation of Investigatory Powers (Juveniles) (Amendment) Order 2018 and comes into force on 20th July 2018.

Amendment of the Regulation of Investigatory Powers (Juveniles) Order 2000

2.-(1) The Regulation of Investigatory Powers (Juveniles) Order 2000(2) is amended as follows.

(2) In article 4 (sources under 16: arrangements for meetings)-

(a)in paragraph (3)(a), after "source;" insert "or";

(b)in paragraph (3)(b)-

(i)after "for his welfare" insert "or is otherwise qualified to represent the interests of the source";

(ii)omit "; or";

(c)omit paragraph (3)(c).

(3) In article 6 (sources under 18: duration of authorisations), for "one month" substitute "four months".

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Regulation of Investigatory Powers (Juveniles) Order 2000 (S.I. 2000/2793), which contains special provisions for the authorisation of covert human intelligence sources who are under the age of eighteen. The amendments extend the duration of such authorisations from 1 month to four months and clarify safeguards for meetings with sources under the age of sixteen.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
