The Parochial Fees (Amendment) Order 2023

In accordance with section 2(1) of the Ecclesiastical Fees Measure 1986( 1), a draft of this Order has been laid before, and approved by, the General Synod.

The Archbishops’ Council, in exercise of the powers conferred by sections 1 and 2 of that Measure( 2), makes the following Order:

Citation and commencement

1.—(1) This Order may be cited as the Parochial Fees (Amendment) Order 2023.

(2) This Order comes into force on the day after the day on which it is laid before Parliament.

Prescribed fees: amendment

2.—(1) In article 6 of the Parochial Fees and Scheduled Matters Amending Order 2019( 3) (prescribed fees), in paragraph (3) (determination of fees for each calendar year), for sub-paragraph (a) (but not the following “and”) substitute—

(a) increased by the lower of—

(i) the percentage by which the Consumer Prices Index (CPI) for August in Year A is greater than that for August in the calendar year preceding Year A, and

(ii) 5%, .

(2) The amendment made by paragraph (1) applies only to parochial fees incurred in respect of a matter occurring—

(a) after the commencement of this Order, and

(b) before the end of 2024.

(3) In its application to the calendar year 2024, article 6 of the Parochial Fees and Scheduled Matters Amending Order (as amended by paragraph (1) of this article) is to have effect as if the first reference in paragraph (3) to Year A (which, in that case, is the calendar year 2023) were a reference to the part of Year A occurring after the commencement of this Order.

The draft of this Order was approved by the General Synod on 8th February 2023.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is made under section 2 of the Ecclesiastical Fees Measure 1986 and amends the Parochial Fees and Scheduled Matters Amending Order 2019 ( S.I. 2019/752) so as to provide that parochial fees under article 6 of that Order increase for the remainder of 2023 and for the whole of 2024 by whichever is the lower of the Consumer Prices Index and 5%.

Amendments have been made to section 1 by section 1 of the Ecclesiastical Fees (Amendment) Measure 2011 and section 8 of the Church of England (Miscellaneous Provisions) Measure 2018 (No. 7).
