The Secretary of State makes these Regulations in exercise of the powers conferred by section 44(4)(a) and (b) of the Police, Crime, Sentencing and Courts Act 2022( 1).

In accordance with section 44(8) of that Act, a draft of these Regulations has been laid before and approved by a resolution of each House of Parliament.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Police, Crime, Sentencing and Courts Act 2022 (Extraction of information from electronic devices) (Amendment of Schedule 3) Regulations 2023 and come into force on the day after the day on which they are made.

(2) These Regulations extend to England and Wales, Scotland and Northern Ireland.

Amendments to Schedule 3 to the Police, Crime, Sentencing and Courts Act 2022

2.—(1) Schedule 3 to the Police, Crime, Sentencing and Courts Act 2022 (extraction of information from electronic devices: authorised persons) is amended as follows.

(2) In Part 1 (authorised persons in relation to all purposes within section 37 or 41), after “A National Crime Agency officer” insert—

A member of the Royal Navy Police, the Royal Military Police or the Royal Air Force Police. .

(3) In Part 2 (authorised persons in relation to all purposes within section 37) omit “A member of the Royal Navy Police, the Royal Military Police or the Royal Air Force Police.”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend Schedule 3 to the Police, Crime, Sentencing and Courts Act 2022    (c. 32)so that members of the Royal Navy Police, the Royal Military Police and the Royal Air Force Police are specified as authorised persons who can exercise the powers for all purposes within sections 37 and 41 (rather than only section 37) of that Act.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sectors or community bodies is foreseen.
