The Education (Pupil Information, School Performance Information and National Curriculum Attainment Targets and Programmes of Study) (England) (Amendment) Regulations 2024

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 408, 537, 537A, 563 and 569(4) of the Education Act 1996( 1) and sections 87(3)(a) and (b), (5) and 210(7) of the Education Act 2002( 2).

In accordance with section 408(5) of the Education Act 1996 the Secretary of State has consulted those persons with whom consultation appeared to the Secretary of State to be desirable.

In accordance with section 96(2), (3) and (4) of the Education Act 2002( 3), the Secretary of State gave notice of the proposal in regulation 4 of these Regulations to the bodies and persons mentioned in those subsections and gave them a reasonable opportunity of submitting evidence and representations as to the issues arising.

In accordance with section 96(5) of the Education Act 2002, after consideration of any such evidence and representations, the Secretary of State published a draft of the proposed regulations and associated documents, and a summary of the views expressed during the consultation.

In accordance with section 96(6) of the Education Act 2002, the Secretary of State allowed a period of at least one month beginning with the publication of the draft of the proposed regulations for the submission of further evidence and representations as to the issues arising.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Education (Pupil Information, School Performance Information and National Curriculum Attainment Targets and Programmes of Study) (England) (Amendment) Regulations 2024.

(2) These Regulations come into force on 1st June 2024.

(3) These Regulations extend to England and Wales.

Amendment of the Education (Pupil Information) (England) Regulations 2005

2.—(1) The Education (Pupil Information) (England) Regulations 2005( 4) are amended as follows.

(2) In regulation 2 (interpretation)—

(i) in the definition of “the engagement model”, for “23rd July 2020” substitute “15th April 2024”;

(ii) in the definition of “the pre-key stage standards document for key stage 1”, for “23rd July 2020” substitute “15th April 2024”.

Amendment of the Education (School Performance Information) (England) Regulations 2007

3.—(1) The Education (School Performance Information) (England) Regulations 2007( 5) are amended as follows.

(2) In paragraph (1) of regulation 2 (interpretation)—

(i) in the definition of “the engagement model”, for “23rd July 2020” substitute “15th April 2024”;

(ii) in the definition of “the pre-key stage standards for key stage 1”, for “23rd July 2020” substitute “15th April 2024”.

Amendment of the Education (National Curriculum) (Attainment Targets and Programmes of Study) (England) Order 2013

4.—(1) The Education (National Curriculum) (Attainment Targets and Programmes of Study) (England) Order 2013( 6) is amended as follows.

(2) In article 2 (interpretation)—

(i) in subparagraph (aa) (the engagement model), for “23rd July 2020” substitute “15th April 2024”;

(ii) in subparagraph (c) (the pre-key stage standards for key stage 1), for “23rd July 2020” substitute “15th April 2024”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend certain other instruments to update the references to two external documents referred to in those other instruments. Those documents relate to attainment targets and assessment arrangements for children working below the standards of the National Curriculum in Key Stage 1 and Key Stage 2. The amendments reflect the publication dates of updated versions of those documents.

Regulations 2, 3 and 4 amend, respectively, the Education (Pupil Information) (England) Regulations 2005 ( S.I. 2005/1437), the Education (School Performance Information) (England) Regulations 2007 ( S.I. 2007/2324) and the Education (National Curriculum) (Attainment Targets and Programmes of Study) (England) Order 2013 ( S.I. 2013/2232), in each case to change the publication date of the “pre-key stage standards document for key stage 1” and the “engagement model” from “23rd July 2020” to “15th April 2024”.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sectors is foreseen.

Section 537A was inserted by section 20 of the 1997 Act and amended by paragraph 153 of Schedule 30 to the 1998 Act; S.I. 2012/976; and S.I. 2010/1158. Section 563 was amended by paragraph 172 of Schedule 30, and Schedule 31, to the 1998 Act and S.I. 2010/1158. There are amendments to section 569 but none are relevant to these Regulations.

2002 c. 32. Section 87(5) was amended by section 103(2), paragraph 10(1) and (5) of Schedule 1 and Part 1 of Schedule 3 to the Childcare Act 2006 (c. 21); and paragraphs 31 and 35(1) and (2) of Schedule 12 to the 2009 Act. There are other amendments to sections 87 and 210 that are not relevant to these Regulations.
