The Secretary of State makes this Order in exercise of the powers conferred by sections 54(1)(b) and 154(5)(a) and (b) of the Police Reform and Social Responsibility Act 2011( 1).
The Secretary of State has consulted the Electoral Commission in accordance with section 7(1) and (2)(ha) of the Political Parties, Elections and Referendums Act 2000( 2).
1.—(1) This Order may be cited as the Police and Crime Commissioner Elections (Designation of Local Authorities and Police Area Returning Officers) (Amendment) Order 2024.
(2) This Order comes into force on the day after the day on which it is made.
(3) In this Order “ the 2024 Order” means the Police and Crime Commissioner Elections (Designation of Local Authorities and Police Area Returning Officers) Order 2024( 3).
2.—(1) The 2024 Order is amended as follows.
(2) In Article 1(4), in the definition of “police area”, after “North Yorkshire” insert “, South Yorkshire( 4)”.
(3) For the table in Schedule 3 (designated police area returning officers in England) substitute the table in Schedule 1 to this Order.
(4) For the table in Schedule 4 (designated police area returning officers in Wales) substitute the table in Schedule 2 to this Order.
3.—(1) This Order does not affect the validity of anything done by or in relation to a police area returning officer designated by the 2024 Order before the coming into force of this Order.
(2) Any charges incurred for specified services or specified expenses by a police area returning officer designated for a police area by the 2024 Order before the coming into force of this Order are to be treated as having been incurred by the police area returning officer who is designated for the same police area following the coming into force of this Order for the purpose of each maximum recoverable amount for that police area.
(3) In this article—
“ maximum recoverable amount” means the amount specified in, as the case may be, column (2), (3) or (4) of the table in Schedule 3 to the Police and Crime Commissioner Elections (Local Returning Officers’ and Police Area Returning Officers’ Charges) Order 2024( 5);
“ specified services” and “ specified expenses” have the same meaning as in Article 3 of the Police and Crime Commissioner Elections (Local Returning Officers’ and Police Area Returning Officers’ Charges) Order 2024.

This Order amends the Police and Crime Commissioner Elections (Designation of Local Authorities and Police Area Returning Officers) Order 2024 ( S.I. 2024/186) (“ the 2024 Order”).
The 2024 Order designates, under section 54(1)(b) of the Police Reform and Social Responsibility Act 2011 (c. 13), the persons who are to be the returning officers for police and crime commissioner elections in the police areas named in Schedules 3 and 4 to that Order.
Article 2 of this Order amends the 2024 Order to reflect changes to the parliamentary constituencies following the Parliamentary Constituencies Order 2023 ( S.I. 2023/1230), which takes effect fully on the dissolution of parliament on 30th May 2024.
Article 3 provides that this Order does not affect the validity of anything done by or in relation to a police area returning officer designated by the 2024 Order before the coming into force of this Order. It also provides that any charges incurred before this Order came into force for specified services or specified expenses by a police area returning officer designated by the 2024 Order are to be treated as having been incurred by the police area returning officer designated for the same police area following the coming into force of this Order for the purpose of each maximum recoverable amount for that police area.
An impact assessment has not been produced for this instrument as no, or no significant, impact on the private voluntary or public sectors is foreseen.
2011 c. 13; section 54(1)(b) was amended by S.I. 2015/1376, 2016/997and 2021/1265. Section 154(5) was amended by S.I. 2014/268and 2021/1265.
2000 c. 41. Section 7(2)(ha) was inserted by paragraph 11 of Schedule 10 to the Police Reform and Social Responsibility Act 2011.
The functions of a police and crime commissioner in respect of South Yorkshire have been transferred to the mayor of the South Yorkshire Combined Authority by S.I. 2024/414. See paragraph 21(b) and (d) of Schedule 2, the effect of which is to remove the requirement to designate both a police area returning officer under section 54(1)(b) of the 2011 Act and a local authority for the purposes of section 75(1) of that Act in respect of the South Yorkshire Combined Authority.
