The Charges for Residues Surveillance (Amendment) (England) Regulations 2024

The Secretary of State makes these Regulations in exercise of the powers conferred by sections 45 and 48(1)(b) and (c) of the Food Safety Act 1990( 1) and now vested in the Secretary of State( 2).

In accordance with section 48(4A)( 3) of that Act the Secretary of State has had regard to advice given by the Food Standards Agency on the proposal to make these Regulations.

There has been consultation as required by Article 9 of Regulation (EC) No.178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety( 4).

Citation, commencement, extent and application

1.—(1) These Regulations may be cited as the Charges for Residues Surveillance (Amendment) (England) Regulations 2024 and come into force on 1st October 2024.

(2) These Regulations extend to England and Wales.

(3) These Regulations apply in relation to England only.

Amendments to the Charges for Residues Surveillance Regulations 2006

2.—(1) The Charges for Residues Surveillance Regulations 2006( 5) are amended as follows.

(2) In regulation 3(1) for the words from “, for each animal” to the end substitute—

(a) for animals slaughtered, wild game prepared, fish other than trout marketed, trout for which feed is purchased, milk collected or eggs packed within the period beginning with 1st October 2024 and ending with 31st March 2025, charge the amount specified in the corresponding entry in the second column of that Schedule;

(b) for animals slaughtered, wild game prepared, fish other than trout marketed, trout for which feed is purchased, milk collected or eggs packed on or after 1st April 2025, charge the amount specified in the corresponding entry in the third column of that Schedule. .

(3) For Schedule 1 substitute—

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Charges for Residues Surveillance Regulations 2006 ( S.I. 2006/2285).

These amendments vary the fees required to be paid in respect of the Secretary of State’s surveillance of animals and animal products for residues of veterinary medicinal products and other substances.

Changes to fees are itemised in the table below.

A full impact assessment has not been prepared for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.

The powers, so far as they are exercisable in relation to England, were transferred by article 2(6) of the Transfer of Functions (Agriculture and Food) Order 1999 ( S.I. 1999/3141) to the Minister of Agriculture, Fisheries and Food and the Secretary of State acting jointly, and by article 2(3) of the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 ( S.I. 2002/794) to the Secretary of State.
