The Community Care (Direct Payments) Amendment (Wales) Regulations 2000

  Made 7th July 2000 
  Coming into force 14th July 2000 

The National Assembly for Wales makes the following Regulations in exercise of the powers conferred on the Secretary of State by section 1(1) of the Community Care (Direct Payments) Act 1996[1], and now vested in the National Assembly for Wales [2]:

Citation, commencement and application
     1.  - (1) These Regulations may be cited as the Community Care (Direct Payments) Amendment (Wales) Regulations 2000, and shall come into force on 14 July 2000.

    (2) These Regulations shall apply to Wales only.

Amendment of the Community Care (Direct Payments) Regulations 1997
    
2. In regulation 2 of the Community Care (Direct Payments) Regulations 1997[3] (persons to whom direct payments may be made), sub-paragraph (a) of paragraph (2) shall be omitted.

EXPLANATORY NOTE

(This note does not form part of the Regulations)


The Community Care (Direct Payments) Act 1996 enables a local authority responsible for providing (or arranging provision of) community care services to make contributions by way of direct payments to persons so that they may secure the provision of such services.

The Community Care (Direct Payments) Regulations 1997 specify the persons to whom direct payments may be made under the Act. The description of such persons excludes any person who is aged 65 or over, unless that person received a direct payment in the year before attaining the age of 65.

These Regulations amend the 1997 Regulations so that the persons to whom direct payments may be made under the Act include persons aged 65 or over irrespective of whether they received such a payment in the year before attaining the age of 65.
