The National Assembly for Wales makes the following Regulations in exercise of the powers conferred on the Secretary of State by sections 46(1) and (3) and 54(3) and (4) of the Education Act 1997[1] and now vested in the National Assembly for Wales[2]:
Citation, commencement and application
1.
- (1) These Regulations are called the Education (Extension of Careers Education) (Wales) Regulations 2001 and shall come into force on 1st August 2001.
(2) They apply only to Wales.
Extension of provisions of section 43(5) of the Education Act 1997

Sections 43 and 44 of the Education Act 1997 shall have effect as if there were substituted for the period specified in section 43(5) as the relevant phase of a pupil's education the period -
(a) beginning at the same time as the school year in which the majority of pupils in his class attain the age of 14; and
(b) ending with the expiry of the school year in which the majority of pupils in his class attain the age of 19.
Requirement to provide careers education at institutions in the further education sector

- (1) This regulation applies in relation to persons attending institutions within the further education sector (whether attending full-time or part-time) who have attained the age of 16 but who have not attained the age of 20.
(2) The governing bodies of those institutions and the principals or other heads of those institutions must secure that a programme of careers education is provided for those persons to whom this regulation applies.
(3) In this regulation -
"institutions within the further education sector" ("sefydliadau o fewn y setor addysg bellach") has the same meaning as in section 91(3) of the Further and Higher Education Act 1992[3];
"careers" ("gyrfaoedd") includes the undertaking of any training, employment or occupation or any course of education;
"careers education" ("addysg gyrfaoedd") means education designed to prepare persons for taking decisions about their careers and to help them implement such decisions.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations which apply to Wales make provision for extending the requirement to provide a programme of careers education to include pupils who are over compulsory school age and students aged between 16 and 19 attending institutions within the further education sector.
Regulation 2 extends the requirement in section 43 of the Education Act 1997 to provide a programme of careers education to cover pupils aged between 14 and 19, rather than 14 - 16 as section 43 currently requires.
Regulation 3 imposes an entirely new requirement for students aged 16 - 19 attending further education institutions to be provided with a programme of careers education.
