In exercise of the powers conferred on the Secretary of State by sections 118(1)(b), and 138(7) and (8) of the School Standards and Framework Act 1998[1], now vested in the National Assembly for Wales[2], the National Assembly for Wales makes the following Regulations:
Title, commencement and application

—(1) These Regulations are called the Education (Nursery Education and Early Years Development and Childcare Plans) (Wales) (Amendment) Regulations 2005 and come into force on 31 July 2005.
(2) These Regulations apply in relation to Wales.
Amendment of the Education (Nursery Education and Early Years Development and Childcare Plans) (Wales) Regulations 2003
2.
—(1) The Education (Nursery Education and Early Years Development and Childcare Plans) (Wales) Regulations 2003[3] are amended as follows.
(2) In regulation 4(1)(a) and (b) substitute the word "third" for the word "fourth" in each place it occurs.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Education (Nursery Education and Early Years Development and Childcare Plans) (Wales) Regulations 2003. Under section 118 of the School Standards and Framework Act 1998 a local education authority is under a duty to secure sufficient provision of nursery education for their area for children who have reached a certain age. These Regulations amend that age by referring to terms following a child's third birthday instead of a child's fourth birthday.
