The Education (Listed Bodies) (Wales) Order 2007

  Made 19 September 2007 
  Coming into force 1 October 2007 

The Welsh Ministers, in exercise of the powers conferred upon the Secretary of State by sections 216(2) and 232(5) of the Education Reform Act 1988[1] and now vested in them[2], make the following Order:

Title, commencement and application
     1. —(1) The title of this Order is the Education (Listed Bodies) (Wales) Order 2007 and it comes into force on 1 October 2007.

    (2) This Order applies to Wales.

Listed Bodies
    
2. The bodies that are specified in the Schedule to this Order comprise all those bodies that appear to the Welsh Ministers to fall for the time being within section 216(3) of the Education Reform Act 1988.

Revocation
    
3. The Education (Listed Bodies) (Wales) Order 2004[3] and the Education (Listed Bodies) (Wales) (Amendment) Order 2005 are revoked[4].

EXPLANATORY NOTE

(This note is not part of the Order)


This Order lists the name of every body which is not a recognised body within section 216(4) of the Education Reform Act 1988 but which appears to the Welsh Ministers to either —

"Recognised bodies" are universities, colleges, or other bodies which are authorised by Royal Charter or by or under Act of Parliament to grant degrees and other bodies for the time being permitted by those bodies to act on their behalf in the granting of degrees.

The Order updates and replaces the list of bodies contained in the Education (Listed Bodies) (Wales) Order 2004 (S.I. 2004/3095), as amended by the Education (Listed Bodies) (Wales) (Amendment) Order 2005. This Order revokes both the 2004 Order and the 2005 Order.

Part 1 of the Schedule to this Order lists all of those bodies that appear to the Welsh Ministers to provide courses in preparation for a degree, whether generally, as listed in section 1, or in respect of a foundation degree only, as listed in section 2. Part 2 of the Schedule lists all of those bodies that appear to the Welsh Ministers to be constituent colleges, schools, halls or other institutions of a university.

There are omitted from the Schedule to this Order a number of bodies that were listed in previous Orders but which no longer provide courses that are approved by or behalf of a recognised body. The Schedule includes bodies that were not listed in previous Orders but which now provide courses that are approved by or on behalf of a recognised body and incorporates other minor amendments and name changes. The Schedule reflects the restructure of the University of Wales from a federal to a non-federal institution, meaning that it no longer has constituent members listed in Part 2 of the Schedule.
