The Welsh Ministers in exercise of powers conferred by section 18(1) and (2) of and paragraphs 5 and 7 of Schedule 3 to the National Health Service (Wales) Act 2006(1), and section 25 of the Welsh Language Act 1993(2), after completion of the consultation prescribed under section 18(3) of that Act, hereby make the following Order:
1.–(1) The title of this Order is the Abertawe Bro Morgannwg University National Health Service Trust (Establishment) Order 2008 and it comes into force on 12 March 2008.
(2) In this Order unless the context otherwise requires –
"the Act" ("y Ddeddf") means the National Health Service (Wales) Act 2006;
"community health services" ("gwasanaethau iechyd cymunedol") means any service which the Welsh Ministers may provide under section 3(1) of or Schedule 1 to the Act;
"establishment date" ("dyddiad sefydlu") means 12 March 2008;
"operational date" ("dyddiad gweithredol") has the meaning assigned to it in paragraph 5(5) of Schedule 3 to the Act;
"the trust" ("yr ymddiriedolaeth") means the Abertawe Bro Morgannwg University National Health Service Trust established by article 2 of this Order.
2. There is hereby established a National Health Service trust which is called the Abertawe Bro Morgannwg University National Health Service Trust or Ymddiriedolaeth Brifysgol Gwasanaeth Iechyd Gwladol Abertawe Bro Morgannwg.
3.–(1) The trust is established for the purposes specified in section 18(1) of the Act.
(2) The trust´s functions are –
(a) to provide goods and services (including hospital accommodation and community health services) from –
(i) Cefn Coed Hospital, Waunarlwydd Road, Cockett, Swansea, SA2 0GH,
(ii) Glanrhyd Hospital, Tondu Road, Bridgend, CF31 4LN,
(iii) Morriston Hospital, Morriston, Swansea SA6 6NL,
(iv) Neath Port Talbot Hospital, Baglan Way, Port Talbot, SA12 7BX,
(v) Princess of Wales Hospital, Coity Road, Bridgend CF31 1RQ,
(vi) Singleton Hospital, Sketty, Swansea, SA2 8QA,
and associated hospitals and premises; and
(b) to provide to or in relation to the health service in Wales procurement services and to procure goods and services for the purpose of the health service in Wales.
4.–(1) The trust has, in addition to the chairman, 7 non-executive directors and 5 executive directors.
(2) Since the trust is to be regarded as having a significant teaching commitment within the meaning of paragraph 5(3) of Schedule 3 to the Act, one of the non-executive directors is to be appointed from Swansea University.
5.–(1) The operational date of the trust is 1 April 2008.
(2) The accounting date of the trust is 31 March .
6. Between its establishment date and its operational date the trust has the functions-
(a) of entering into NHS contracts;
(b) of entering into other contracts including contracts of employment; and
(c) of doing such other things as are reasonably necessary to enable it to begin to operate satisfactorily with effect from its operational date.

This Order establishes the Abertawe Bro Morgannwg National Health Service Trust, an NHS trust provided for in section 18 of the National Health Service (Wales) Act 2006. It also provides for the functions of the trust (article 3) and the number of executive and non-executive directors (article 4). It specifies the operational date and accounting date of the trust (article 5).
1993 c. 38, Functions of any Minister of the Crown were transferred to the National Assembly for Wales by virtue of article 2, Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999. Functions of the National Assembly for Wales are exercisable by the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006. Back [2]
