The Welsh Ministers in exercise of the powers conferred by section 2 of the Abortion Act 1967(1) hereby make the following Regulations:
1.–(1) The title of these Regulations is the Abortion (Amendment) (Wales) Regulations 2008 and they come into force on 17 June 2008.
(2) These Regulations apply in relation to Wales.
(3) In these Regulations "the principal Regulations" ("y prif Reoliadau") means the Abortion Regulations 1991(2).
2. In regulation 2 (interpretation) of the principal Regulations, insert the following definitions in the appropriate place in the alphabetical order–
""the Statistics Board" means the Statistics Board established under section 1 of the Statistics and Registration Service Act 2007(3);
"the Chief Medical Officer for Wales" means the Chief Medical Officer to the Welsh Assembly Government;".
3. In regulation 4(2)(b) (which relates to notice of termination and information relating to the termination) of the principal Regulations, for "National Assembly for Wales" substitute "Welsh Assembly Government".
4. In regulation 5 (restriction on disclosure of information) of the principal Regulations –
(a) in paragraph (a)(i), for "the National Assembly for Wales" substitute "the Welsh Assembly Government";
(b) for paragraph (a)(ii) substitute–
"(ii) to the chairman of the Statistics Board or a member of the Statistics Board´s staff who has been duly authorised by the chairman.".

These Regulations amend regulations 2 and 4 of the Abortion Regulations 1991(4) ("the principal Regulations") in order to reflect the changes upon the title of the Chief Medical Officer for Wales consequential to the establishment of the Welsh Assembly Government in accordance with the Government of Wales Act 2006(5).
They also amend regulations 2 and 5 of the principal Regulations to reflect the changes made by the Statistics and Registration Service Act 2007(6) which establishes an independent statistics board which is responsible for the statistical functions previously carried out by the Registrar General through its administrative arm, the Office of National Statistics.
No regulatory impact assessment has been prepared in relation to these Regulations.
1967 c. 87 ("the Act"). The functions under section 2 of the Act were transferred in relation to Wales to the National Assembly for Wales in accordance with article 2 of and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), and thereafter transferred to the Welsh Ministers in accordance with paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
