The Civil Enforcement of Parking Contraventions (County of Flintshire) Designation (No. 2) Order 2013

This Order is made by the Welsh Ministers, in exercise of the powers conferred upon the National Assembly for Wales by paragraph 8(1) of Schedule 8 and paragraph 3(1) of Schedule 10 to the Traffic Management Act 2004(1) and now vested in them(2).

Flintshire County Council has applied to the Welsh Ministers for an Order to be made under these powers with respect to part of its area.

The Welsh Ministers have consulted the chief officer of North Wales Police in accordance with the requirements of paragraph 8(3) of Schedule 8 and paragraph 3(4) of Schedule 10 to the Traffic Management Act 2004.

Accordingly, the Welsh Ministers make this Order.

Title, commencement and application

1.-(1) The title of this Order is the Civil Enforcement of Parking Contraventions (County of Flintshire) Designation (No. 2) Order 2013.

(2) This Order comes into force on 1 October 2013 and applies in relation to Wales.

Designation of civil enforcement area and special enforcement area

2.  The Welsh Ministers designate the area described in the Schedule as-

(a)a civil enforcement area for parking contraventions; and

(b)a special enforcement area.

Revocation

3.  The Civil Enforcement of Parking Contraventions (County of Flintshire) Designation Order 2013(3) is hereby revoked.

Article 2

SCHEDULE

Area designated as a civil enforcement area for parking contraventions and a special enforcement area

The whole of the County of Flintshire with the exception of-

(a)the entire length of the A55, including its on and off slip roads, within the county;

(b)those lengths of the A550 from the A548 Deeside Park Interchange to the county boundary with Cheshire;

(c)that length of the dual carriageway section of the A494, including its on and off slip roads, from the county boundary with Cheshire to the A55 junction at Ewloe Interchange

EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates the area described in the Schedule as a civil enforcement area and a special enforcement area for the purposes of Part 6 of the Traffic Management Act 2004. The practical effect of the Order is to enable Flintshire County Council to enforce parking contraventions within the area described in the Schedule to the Order through a civil law regime, as opposed to enforcement by police or traffic wardens in a criminal law context.

Article 3 of this Order revokes and replaces S.I. 2013/1747 (W.173) on account of a defect in that Order.

The functions of the National Assembly for Wales under the Traffic Management Act 2004 were transferred to the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (2006 c.32). By virtue of section 92 of the Traffic Management Act 2004, the National Assembly for Wales was designated as the appropriate national authority as regards Wales, for the purposes of Part 6 of that Act.
