This Order is made by the Welsh Ministers, in exercise of the power conferred upon the National Assembly for Wales by paragraph 8(1) of Schedule 8 and paragraph 3(1) of Schedule 10 to the Traffic Management Act 2004(1) and now vested in them(2).

Vale of Glamorgan Council has applied to the Welsh Ministers for an Order to be made under these powers with respect to part of its area.

The Welsh Ministers have consulted the chief officer of the South Wales Police in accordance with the requirements of paragraph 8(3) of Schedule 8 and paragraph 3(4) of Schedule 10 to the Traffic Management Act 2004.

Title, commencement and application

1.-(1) The title of this Order is the Civil Enforcement of Parking Contraventions (County Borough of Vale of Glamorgan) Designation Order 2013.

(2) This Order comes into force on 1 April 2013 and applies in relation to Wales.

Designation of civil enforcement area and special enforcement area

2. The Welsh Ministers designate the area described in the Schedule as-

(a)a civil enforcement area for parking contraventions; and

(b)a special enforcement area.

Article 2

SCHEDULEArea designated as a civil enforcement area for parking contraventions and a special enforcement area

This Order applies to the whole of the County Borough of Vale of Glamorgan with the exception of-

(a)the M4 Motorway including all slip roads from the boundary with the City and County of Cardiff at a point on the western edge of the western over-bridge at Junction 33, to the boundary with Rhondda Cynon Taf at a point approximately 260 metres west of the centre of Junction 34;

(b)Ministry of Defence roads within Saint Athan including-

The entire length of Aled Way from its junction with Flemingston Road;

The entire lengths of Talybont Close, Clwyd Way, Margam Close, Tintern Close and Celyn Close from their junctions with Aled Way;

The entire lengths of Crynant Close and Ebbw Close from their junctions with Clwyd Close;

The entire length of the unnamed road fronting the Gathering Place Church and Community Centre from its junction with Flemingston Road.

Explanatory Note

(This note is not part of the Order)

This Order designates the area described in the Schedule as a civil enforcement area and a special enforcement area for the purposes of Part 6 of the Traffic Management Act 2004. The practical effect of the Order is to enable the Council of the County Borough of Vale of Glamorgan to enforce parking contraventions within the area described in the Schedule to the Order through a civil law regime, as opposed to enforcement by police or traffic wardens in a criminal law context.

The functions of the National Assembly for Wales under the Traffic Management Act 2004 were transferred to the Welsh Ministers by virtue of section 162 of and paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (2006 c. 32). By virtue of section 92 of the Traffic Management Act 2004, the National Assembly for Wales was designated as the appropriate national authority as regards Wales, for the purposes of Part 6 of that Act.
