Title, commencement, application and interpretation

1.  (1)  The title of this Order is the Marine and Coastal Access Act 2009 (Commencement and Consequential Provisions) (Wales) Order 2014.

(2) This Order comes into force on 12 December 2014.

(3) This Order applies in relation to Wales and the Welsh inshore region.

(4) In this Order the "Welsh inshore region" ("rhanbarth glannau Cymru") has the meaning given by section 322(1) of the Marine and Coastal Access Act 2009.

Appointed day

2.  12 December 2014 is the day appointed for the coming into force of the following provisions of the Marine and Coastal Access Act 2009-

(a)sections 116 to 128 (designation of marine conservation zones; duties relating to the conservation network and duties of public authorities);

(b)sections 134 to 148 (orders for the protection of marine conservation zones in Wales; hearings; offences; fixed monetary penalties; miscellaneous and supplementary provisions; and other conservation sites) and Schedules 10 (further provisions about fixed money penalties under section 142), 11 (consequential amendments relating to MCZs), 12 (transitional provision relating to MCZs) and 13 (marine boundaries of SSSIs and national nature reserves); and

(c)Part 3 (nature conservation) of Schedule 22 (repeals) and section 321 (repeals) so far as relating to that Part.

Revocation of existing enactment

3.  The Wildlife and Countryside (Byelaws for Marine Nature Reserves) Regulations 1986(2) are revoked.

EXPLANATORY NOTE

This Order, which applies in relation to Wales and the Welsh inshore region, brings into force certain provisions of the Marine and Coastal Access Act 2009 ("the 2009 Act").

Article 2 brings into force Chapter 1 of Part 5 of the 2009 Act so far as relating to marine conservation zones in Wales (sections 116 to 128 and 134 to 147) and Chapter 2 of that Part relating to other conservation sites (section 148). Article 2 brings into force the associated Schedules to Part 5 of the 2009 Act including consequential amendments, transitional provisions and repeals.

Article 3 makes a revocation of subordinate legislation consequential to the commencement of Part 5 of the 2009 Act.
