No. 3/1940:

SHANNON FISHERIES (WEEKLY CLOSE SEASON) (VARIATION) ORDER, 1940.

SHANNON FISHERIES (WEEKLY CLOSE SEASON) (VARIATION) ORDER, 1940.

WHEREAS it is enacted by sub-section (1) of Section 22 of the Shannon Fisheries Act, 1935 (No. 4 of 1935), that Section 20 of the Salmon Fishery (Ireland) Act, 1863, shall have effect in relation to the tidal waters of the River Shannon within the meaning of the Fisheries Acts, 1842 to 1925, as if the words " the succeeding Tuesday morning " were substituted in the said Section 20 for the words " the succeeding Monday morning " now contained therein :

AND WHEREAS it is enacted by sub-section (2) of the said Section 22 that the Minister for Agriculture may by order vary as he shall think proper, in respect of the said tidal waters of the River Shannon, the weekly close season fixed in respect of those tidal waters by the said Section 20 of the Salmon Fishery (Ireland) Act, 1863, as amended by the said Section 22, but shall not by any such order increase the said weekly close season to more than seventy-two hours nor reduce the said weekly close season to less than forty-eight hours :

NOW I, SÉAMAS Ó RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by sub-section (2) of Section 22 of the Shannon Fisheries Act, 1935 (No. 4 of 1935), and of every and any other power me in this behalf enabling, do hereby order as follows, that is to say :—

1.—(1) This Order may be cited as the Shannon Fisheries (Weekly Close Season) (Variation) Order, 1940.

(2) This Order shall come into operation on the 1st day of February, 1940.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. The weekly close season in respect of the tidal waters of the River Shannon within the meaning of the Fisheries Acts, 1842 to 1925, shall, in lieu of that fixed by Section 20 of the Salmon Fishery (Ireland) Act, 1863, as amended by Section 22 of the Shannon Fisheries Act, 1935 , be the period of forty-eight hours commencing at the hour of 6 a.m. on each Saturday.
