STATISTICS (CENSUS OF POPULATION) ORDER, 1956.

STATISTICS (CENSUS OF POPULATION) ORDER, 1956.

The Tánaiste, in pursuance of the powers conferred by sub-section (1) of Section 16 of the Statistics Act, 1926 (No. 12 of 1926), and the Statistics Acts, 1926 and 1946 (Transfer of Ministerial Functions) Order, 1949 ( S.I. No. 142 of 1949 ), and by Article 28, section 6.3° of the Constitution, hereby orders as follows :--

1. This Order may be cited as the Statistics (Census of Population) Order, 1956.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. Statistics shall be collected in respect of all areas of the following subject matter, nature and character, that is to say :--

(a) Population.

(b) Names and addresses, sex and date of birth.

(c) Conditions as to marriage,

as of Sunday, 8th April, 1956.

4. In addition to the foregoing, statistics shall be collected in respect of the areas listed in the First Schedule hereto, hereinafter called Special Areas, of the following subject matter, nature and character, that is to say :--

(a) Use of the Irish language.

(b) Ability to speak the Irish language

as of Sunday, 8th April, 1956.

5. The following are the persons, or classes of persons, by whom returns are to be made, or information is to be given, for the purpose of the said statistics, that is to say :--

(a) The head or other person acting as head of a private household ;

(b) the person in charge of an institution, such as a boardinghouse, common or other lodging-house, club, hotel, boarding-school, boarding-college, convent, monastery, barrack, county home, hospital, mental hospital, prison, or other establishment of any kind ;

(c) the master or other person in charge of a steamer, sailing vessel, yacht, fishing boat or craft of any kind in any bay, creek, harbour, port, lake, river, canal or elsewhere in waters within the jurisdiction of the State ;

(d) the captain or other persons in charge of an aircraft which was in transit at midnight (Irish time) on Sunday, 8th April, 1956, and which landed in the State on the morning of Monday, 9th April, 1956 ;

(e) individuals.

6.--(1) Returns shall be made, information shall be given, and the statistics shall be collected in the manner provided by the forms set out in the Second Schedule hereto ;

(2) The collection of the statistics shall be carried out through members of the Garda Síochána and officials of the Department of Posts and Telegraphs.

7.--(1) The Commissioner of the Garda Síochána may appoint such and so many persons (being members of the Garda Síochána) as he thinks fit to be authorised persons for the purpose of this Order, and the appointment of persons under this paragraph may be made by their names or by the designation of their offices or in such other distinguishing manner as the said Commissioner thinks fit.

(2) There shall be issued to every authorised person appointed under this paragraph a certificate signed by a member of the Garda Síochána, not below the rank of Superintendent, certifying that such person has been so appointed.

(3) A member of the Garda Síochána who, while wearing his uniform as such member, produces a certificate under this paragraph to the effect that he has been appointed an authorised person shall, until the contrary is proved, be deemed to be an authorised person.

8.--(1) The Minister for Posts and Telegraphs may appoint such and so many persons, serving in the Department of Posts and Telegraphs, as he thinks fit to be authorised persons for the purposes of this Order and the appointment of persons under this paragraph may be made by their names or by the designation of their offices or in such other distinguishing manner as the said Minister thinks fit.

(2) There shall be issued to every authorised person appointed under this paragraph a certificate signed by an officer of the Department of Posts and Telegraphs, not below the rank of Superintendent, certifying that such person has been so appointed.

(3) An official of the Department of Posts and Telegraphs who, while wearing his uniform as such official, produces a certificate under this paragraph to the effect that he has been appointed an authorised person shall, until the contrary is proved, be deemed to be an authorised person.

9. Every authorised person when acting under these Regulations shall on demand produce and show the certificate issued to him under this Order.

10. The forms set out in the Second Schedule hereto shall be used for the collection of the said statistics.

NOTICE.

Under the Statistics Acts, 1926 and 1946, and Orders made thereunder a return, either in Irish or English, of all the particulars asked for on this Form must be made by :

(1) The head or other person acting as head of a private household in respect of all persons forming part of the household for Census purposes. See heading of column (A).

N.B.--If the house or any room or rooms in the house be let or sublet to separate families or to lodgers (who board separately) each head of a family or lodger must make a return for his portion of the house on a separate Form A.

(2) The person in charge of an institution such as a boarding-school, college, hostel, convent, monastery, barrack, county home, hospital, nursing home, mental hospital, boarding-house, common or other lodging-house, club, hotel, prison, etc., in respect of all persons who are to be included as inmates of the establishment for Census purposes. See heading of column (A).

(3) The Master or other person in charge of a steamer, sailing vessel, yacht, fishing boat, etc., in any bay, creek, harbour, port, lake, river, canal, etc., and generally in waters within the jurisdiction of Ireland in respect of persons who were on board the vessel on the night of Sunday, 8 April, 1956, or who arrived in territorial waters on the morning of Monday, 9 April, 1956, not having been enumerated elsewhere.

(4) The Captain or other person in charge of an aircraft which was in transit at midnight (Irish time) on 8 April, 1956, and which landed in Ireland on the morning of 9 April, 1956, in respect of persons who travelled in that aircraft and who disembarked in Ireland. No return is required in respect of transit passengers.

The Form A will be called for on Monday, 9 April, 1956, or as soon as possible thereafter by the appointed enumerator ; in order that he may not be delayed it must be ready with the answers written in the proper columns early on the morning of that day. If the answers are incomplete or inaccurate the enumerator must ask any questions necessary to enable him to complete the Form. The enumerator will assist such persons as may not be able to fill the form themselves.

If any person whose duty it is to make a return or give information refuses to do so, or wilfully gives false information or uses otherwise than for the purposes of making the return any information given to him for that purpose, be will be liable to the penalties laid down under the Statistics Act, 1926 .

The particulars returned on the Census Schedule are strictly confidential.
