HARBOUR RATES (KINSALE HARBOUR) ORDER, 1982.

HARBOUR RATES (KINSALE HARBOUR) ORDER, 1982.

I, PATRICK COONEY, Minister for Transport, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), and after due compliance with section 106 of that Act, hereby order as follows:--

1. (1) This Order may be cited as the Harbour Rates (Kinsale Harbour) Order, 1982.

(2) This Order shall come into operation on the 24th day of February, 1982.

2. The Harbour Rates (Kinsale Harbour) Order, 1951 ( S.I. No. 8 of 1951 ), is hereby amended by--

( a ) the substitution for Article 2 (2) of the following:

"(2) Where rates fixed under this Order are payable at a metric tonne charge, lesser weights shall be chargeable as follows:--

( a ) any weight not exceeding 250 kilogrammes shall count as 250 kilogrammes,

( b ) any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall count as 500 kilogrammes,

( c ) any weight exceeding 500 kilogrammes but not exceeding 750 kilogrammes shall count as 750 kilogrammes,

( d ) any weight exceeding 750 kilogrammes but not exceeding 1 tonne shall count as 1 tonne."

( b ) the substitution for the First, Second and Third Schedules (inserted by the Harbour Rates (Kinsale Harbour) Order, 1980 ( S.I. No. 281 of 1980 ) of the following Schedules:--

2. Tonnage rates on yachts and pleasure boats:

( a ) On all pleasure boats, yachts, sailing boats, motor boats, rowing boats and other such vessels using the harbour and not paying the composition rate in paragraph 2(b) below for each entry into the harbour for any purpose:--

(i) if under 1 ton gross

(i) if under 1 ton gross

3. Tonnage Rates on Fishing Vessels registered as such and actively engaged in commercial fishing:

( a ) (i) On every fishing vessel of under 10 tons gross not paying the rate mentioned at either paragraph (b) (i) or (b) (ii) below for each entry into the harbour, a sum not exceeding ... ... ...

3. The Harbour Rates (Kinsale Harbour) Order, 1980 is hereby revoked.

EXPLANATORY NOTE.

This Order authorises the Kinsale Harbour Commissioners to increase goods, tonnage and other charges.
