CHILDREN ACT 2001 (COMMENCEMENT) (No. 2) ORDER 2004.

I, BRIAN LENIHAN, Minister of State at the Department of Health and Children, in exercise of the powers conferred on me by Section 2(2)(a) of the Children Act 2001 (No. 24 of 2001) and the Health and Children (Delegation of Ministerial Functions) Order 2003 ( S.I. No. 474 of 2003 ), hereby order as follows:

1.  This Order may be cited as the Children Act 2001 (Commencement) (No. 2) Order 2004.

2.  The 23rd day of September 2004 is fixed as the day on which Parts 2 (other than sections 7(1)(a), 10(2) and 13(2)) and 3 (other than section 23D) of the Children Act 2001 (No. 24 of 2001) come into operation.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Statutory Instrument brings Part 2 (excluding sections 7(1)(a), 10(2) and 13(2)) and Part 3 (excluding section 23D) of the Children Act 2001 into operation.

These Parts regulate family welfare conferencing and the provision of special care services for non offending children in need of special care or protection by health boards. Part 3 also regulates private fostering arrangements.
