HOUSING

The Housing Renovation etc. Grants (Grant Limit) Order (Northern Ireland) 2003

  Made 3rd November 2003 
  Coming into operation 1st December 2003 

The Department for Social Development[1], in exercise of the powers conferred by Article 54(5)[2] of the Housing (Northern Ireland) Order 1992[3] as applied by Regulations[4] made under Article 73 of that Order and now exercisable by it[5] and conferred on it by Articles 64, 106(2) and 148(1) of the Housing (Northern Ireland) Order 2003[6], and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Housing Renovation etc. Grants (Grant Limit) Order (Northern Ireland) 2003 and shall come into operation on 1st December 2003.

Maximum amount
     2.  - (1) The maximum amount of grant which the Executive may pay in respect of an application for -

    (2) In relation to an application for a disabled facilities grant in respect of works for any of the purposes specified in Article 54(1) of the Housing (Northern Ireland) Order 2003 the Executive may, if it thinks fit, pay a further amount in excess of £25,000 subject to the total amount of grant not exceeding £50,000.

Total amount or value of home repair assistance grant
     3. The total amount or value of home repair assistance grant that the Executive may give in respect of the same dwelling in any period of 3 years shall not exceed £5,000.

Application
     4. This Order shall not have effect in relation to an application for a grant made before 1st December 2003.

Revocation and savings
     5.  - (1) The Housing Renovation etc. Grants (Grant Limit) (Amendment) Order (Northern Ireland) 1993[7] and, subject to paragraph (2), the Housing Renovation etc. Grants (Grant Limit) Order (Northern Ireland) 1996[8] are hereby revoked.

    (2) The Housing Renovation etc. Grants (Grant Limit) Order (Northern Ireland) 1996 shall continue to apply to an application for a grant made before 1st December 2003.

EXPLANATORY NOTE

(This note is not part of the Order.)


This Order makes provision in relation to the amount of housing grants that the Housing Executive may pay.

Article 2(1) specifies the maximum amount of grant which the Housing Executive may pay for Renovation, Common Parts, Disabled Facilities, Replacement and HMO grant applications.

Article 2(2) enables the Housing Executive to pay a higher maximum amount of mandatory disabled facilities grant.

Article 3 makes provision relating to the amount or value of Home Repair Assistance grant that the Executive may give.

Article 4 provides that the Order does not apply to an application for a grant made before the Order comes into operation.

Article 5 makes provision for revocations and savings.
