The Scottish Ministers, in exercise of the powers conferred by article 30(1) of the Foot-and-Mouth Disease Order 1983[1] and of all other powers enabling them in that behalf, hereby make the following Order: Citation and commencement 1. This Order may be cited as the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Amendment (No. 5) Order 2001 and shall come into force at 12.00 noon on 16th August 2001. Amendment of the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Order 2001 2. - (1) The Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Order 2001[2] is amended in accordance with this article. (2) In article 4-
(b) for paragraphs (7) and (8) there are substituted-
(8) Notwithstanding the prohibition in paragraph (7) above-
(b) the use of a place in the course of movement of animals may be authorised by the Scottish Ministers for the purposes of paragraph (4)(b) above.";
(c) in paragraph (10), for "paragraph (4)" there is substituted "paragraphs (4) and (7)"; and
