The Solicitors' Incorporated Practices (Amendment) Order 2001

  Made 1st March 2001 
  Laid before Parliament 2nd March 2001 
  Coming into force 6th April 2001 

The Lord Chancellor, in exercise of the powers conferred on him by section 9(7) of the Administration of Justice Act 1985[1] and of all other enabling powers, makes the following Order:

     1. This Order may be cited as the Solicitors' Incorporated Practices (Amendment) Order 2001 and shall come into force on 6th April 2001.

    
2. In article 3 of the Solicitors' Incorporated Practices Order 1991[2], after the words "In this Order: - " there shall be inserted the following definitions -

EXPLANATORY NOTE

(This note is not part of the Order)


Section 9 of the Administration of Justice Act 1985 (c. 61) allows the Council of the Law Society (with the concurrence of the Master of the Rolls) to make rules to recognise and regulate bodies corporate (referred to as "recognised bodies") for the purpose of providing legal services. The Solicitors' Incorporated Practices Order 1991 (S.I. 1991/2684) provides for certain enactments passed or made before the commencement of section 9, which have effect in relation to solicitors, to apply to recognised bodies. This Order amends the Solicitors' Incorporated Practices Order 1991 under the powers conferred by section 9(7) of the Administration of Justice Act 1985 and interpreted by section 14 of the Interpretation Act 1978 (c. 30). The amendments allow the enactments referred to in the Solicitors' Incorporated Practices Order 1991 to apply to limited liability partnerships, which are recognised bodies, and to their members. A limited liability partnership is a legal entity formed by being incorporated under the Limited Liability Partnerships Act 2000 (c. 12).
