The Children and Family Court Advisory and Support Service (Provision of Grants) Regulations 2001

  Made 5th March 2001 
  Laid before Parliament 7th March 2001 
  Coming into force 1st April 2001 

The Lord Chancellor, in exercise of the powers conferred upon him by section 12(3) and (4) of the Criminal Justice and Court Services Act 2000[1], makes the following Regulations:

     1. These Regulations may be cited as the Children and Family Court Advisory and Support Service (Provision of Grants) Regulations 2001 and shall come into force on 1st April 2001.

    
2. The Service may provide a grant to any person for the purpose of furthering the performance of any of its functions provided that the grant - 

     3.  - (1) The Service shall provide a person with no more than one grant for each particular purpose in any one year.

    (2) The Service shall provide each grant for a period of no more than one year and this shall be known as the "grant period".

    (3) The Service shall specify, when providing the grant, the date on which the grant period ends.

    
4.  - (1) At the end of the grant period the person in receipt of the grant shall repay to the Service any amount of the grant that has not been expended.

    (2) If a person uses a grant for a purpose that is prohibited by regulation 2, the whole of the grant shall be repaid immediately.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations allow the Children and Family Court Advisory and Support Service ("the Service") to provide grants to any person for the purpose of furthering the performance of any of the Service's functions.

The Service is established under section 11 of the Criminal Justice and Court Services Act 2000. The principal functions of the Service are, in respect of family proceedings in which the welfare of children is or may be in question, to safeguard and promote the welfare of the children, to give advice in any court about any application, to make provision for the children to be represented and to provide information, advice and other support for the children and their families.
