The Teachers' Pensions (Amendment) Regulations 2001

  Made 7th March 2001 
  Laid before Parliament 9th March 2001 
  Coming into force 31st March 2001 

The Secretary of State for Education and Employment, in exercise of the powers conferred by sections 9 and 12 of, and Schedule 3 to, the Superannuation Act 1972[1], after consulting with representatives of local education authorities, teachers and other persons likely to be affected in accordance with section 9(5) of that Act, and with the consent of the Treasury[2], hereby makes the following Regulations:

Citation, commencement and interpretation
     1.  - (1) These regulations may be cited as the Teachers' Pensions (Amendment) Regulations 2001 and shall come into force on 31st March 2001.

    (2) In these regulations "the Principal Regulations" means the Teachers' Pensions Regulations 1997[
3].

Amendment of Principal Regulations
     2. The Principal Regulations shall be amended in accordance with regulations 3 to 7.

    
3. In regulation C1(5)(a) after "include any payment" there shall be inserted - 

     4. In regulation C1(5)(b) after "include any payment" there shall be inserted - 

     5. In Schedule 1 the following definition shall be inserted at the appropriate place in alphabetical order - 

" "School Achievement Award"

A payment granted in respect of a school, in recognition of excellence or improvement, under the scheme established by the Secretary of State known as the School Achievement Award Scheme.

".


    
6. In Schedule 2, paragraph 5(a) for the words "or, as the case may be, a city college for the technology of the arts, or", there shall be substituted "a city college for the technology of the arts, or, as the case may be, a city academy, or".

    
7. In Schedule 2, paragraph 5(b) for the words "or, as the case may be, a city college for the technology of the arts.", there shall be substituted "a city college for the technology of the arts, or, as the case may be, a city academy.".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These regulations amend the Teachers' Pensions Regulations 1997.

The regulations provide for payments under the School Achievement Award Scheme to be non-contributable for the purposes of teachers' pensions, notwithstanding the general rule that performance-related pay measures should be contributable (regulations 3 and 4).

Schedule 2, paragraph 5 is amended to include City Academies within the Teachers' Pension Scheme (regulations 6 and 7).
