SOCIAL SECURITY

The Social Security (Breach of Community Order) (Consequential Amendments) Regulations 2001

The Secretary of State for Social Security, in exercise of the powers conferred upon him by sections 22(5), 122(1), 123(1)(d) and (e), 137(1) and 175(1), (3) and (4) of the Social Security Contributions and Benefits Act 1992[1], sections 5(3), 21, 26(1) and (4)(d), 35(1) and 36(1), (2) and (4) of, and paragraph 8 of Schedule 1 to, the Jobseekers Act 1995[2], sections 9(1), 10(3) and (6), 79(1) and 84 of the Social Security Act 1998[3] and section 69(2)(a) of the Child Support, Pensions and Social Security Act 2000[4], and of all other powers enabling him in that behalf, after consultation, in relation to regulation 2(1), with organisations appearing to him to be representative of the authorities concerned[5] and which is made before the end of a period of six months beginning with the coming into force of sections 62 to 65 of the Child Support, Pensions and Social Security Act 2000[6], hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Social Security (Breach of Community Order) (Consequential Amendments) Regulations 2001 and shall come into force on 15th October 2001.

Consequential amendments
    
2.  - (1) In regulation 2(3A) of both the Housing Benefit (General) Regulations 1987[7] and the Council Tax Benefit (General) Regulations 1992[8] (interpretation), after sub-paragraph (c), there shall be added the following sub-paragraph - 

    (2) In the Social Security and Child Support (Decisions and Appeals) Regulations 1999[9] - 

    (3) In regulation 3(1) of the Social Security (Back to Work Bonus) (No. 2) Regulations 1996[11] (period of entitlement to a qualifying benefit: further provisions), after the words "section 19" there shall be inserted the words "or in accordance with section 62 or 63 of the Child Support, Pensions and Social Security Act 2000 (loss of benefit provisions)".

    (4) In the Jobseeker's Allowance Regulations 1996[12] - 

    (5) At the end of regulation 8A(2) of the Social Security (Credits) Regulations 1975[13] (credits for unemployment), there shall be added the following - 

    (6) At the end of regulation 3 of the Discretionary Financial Assistance Regulations 2001[14] (circumstances in which discretionary housing payments may be made), there shall be added the following paragraph -

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations are made in consequence of sections 62 to 65 of the Child Support, Pensions and Social Security Act 2000 (c.19) ("the Act") which relate to restrictions in payment of certain benefits where a person has been found by a court to have breached a community service order.

The Regulations are made before the end of the period of six months beginning with the coming into force of the relevant provisions in the Act and are therefore exempt from the requirement in section 172(1) of the Social Security Administration Act 1992 (c.5) to refer proposals to make these Regulations to the Social Security Advisory Committee and are made without reference to that Committee.

Regulation 2(1) amends the Housing Benefit (General) Regulations 1987 (S.I. 1987/1971) and the Council Tax Benefit (General) Regulations 1992 (S.I. 1992/1814) so as to ensure that those whose income support and jobseeker's allowance are so restricted, do not lose their housing benefit or council tax benefit as a result.

Regulation 2(2) amends the Social Security and Child Support (Decisions and Appeals) Regulations 1999 (S.I. 1999/991) to ensure that the decision making and appeal mechanisms apply to decisions to restrict income support and jobseeker's allowance for such reasons.

Regulation 2(3) and (4) respectively make consequential amendments to the Social Security (Back to Work Bonus) (No. 2) Regulations 1996 (S.I. 1996/2570) and to the Jobseeker's Allowance Regulations 1996 (S.I. 1996/207).

Regulation 2(5) amends the Social Security (Credits) Regulations 1975 (S.I. 1975/556) to ensure that those whose jobseeker's allowance is restricted for such reasons do not lose credits for unemployment.

Regulation 2(6) amends the Discretionary Financial Assistance Regulations 2001 (S.I. 2001/1167) to provide that discretionary housing payments shall not be made where the requirement for financial assistance arises as a consequence of such a restriction.

These Regulations do not impose a charge on business.
