CRIMINAL LAW, ENGLAND AND WALES

The Criminal Justice and Court Services Act 2000 (Commencement No. 7) Order 2001

  Made 19th June 2001 

The Secretary of State, in exercise of the powers conferred upon him by section 80 of the Criminal Justice and Court Services Act 2000[1], hereby makes the following Order:

     1. This Order may be cited as the Criminal Justice and Court Services Act 2000 (Commencement No. 7) Order 2001.

    
2. The following provisions of the Criminal Justice and Court Services Act 2000 shall come into force for the purpose of exercising any order-making powers conferred on the Secretary of State on 20th June 2001, and for all other purposes on 2nd July 2001 - 

     3. This Order extends to England and Wales only.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order applies to England and Wales. It brings into force the following sections of the Criminal Justice and Court Services Act 2000 for the purposes of exercising order making powers on 20th June 2001 and for all other purposes on 2nd July 2001: section 47 (drug abstinence orders); section 48 (pre-sentence drug testing); section 49 (community sentences: drug abstinence requirements); section 50 (community sentences: curfew requirements); section 52 (community sentences: electronic monitoring of requirements), except in so far as it relates to exclusion orders and exclusion requirements; section 57 (testing persons in police detention) within certain police areas; section 58 (right to bail: relevance of drug misuse); section 63 (supervision of young offenders after release); section 64 (release on licence etc: drug testing requirements); section 70 (interpretation etc.) and Schedule 6 (trigger offences). The Order also brings into force related minor and consequential amendments and repeals on the same date.
