The Secretary of State for Health, in exercise of the powers conferred on him by sections 11(4) and 126(3) and (4) of the National Health Service Act 1977[1] and all other powers enabling him in that behalf, hereby makes the following Order:
Citation, commencement and interpretation
1.
- (1) This Order may be cited as the Family Health Services Appeal Authority (Change of Name) Order 2001 and shall come into force on 24th November 2001.
(2) In this Order -
"the Establishment Order" means the Family Health Services Appeal Authority (Establishment and Constitution) Order[2];
"the Regulations" means the Family Health Services Appeal Authority Regulations[3];
"the Health Service Commissioner Order" means the Health Service Commissioner (Family Health Services Appeal Authority) Order[4];
"the Special Health Authority" means the Special Health Authority established by article 2 of the Establishment Order.
Change of name of the Special Health Authority

The name by which the Special Health Authority is known is changed to the Family Health Services Appeal Authority (Special Health Authority).
Consequential and transitional provisions

- (1) In the Establishment Order, the Regulations or the Health Service Commissioner Order for the name "Family Health Services Appeal Authority" wherever it is used the name "Family Health Services Appeal Authority (Special Health Authority)" shall be substituted.
(2) The change of name under this Order shall not -
(a) affect any right or obligation of any person, or
(b) be taken as invalidating any instrument (whether made before, on or after the day on which this Order comes into force) which refers to the Special Health Authority by its previous name and all instruments and other documents which refer to it under its previous name shall be construed as referring to it under its new name.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order changes the name of the Family Health Services Appeal Authority to the Family Health Services Appeal Authority (Special Health Authority) and makes consequential amendments to the Family Health Services Appeal Authority (Establishment and Constitution) Order 1995, the Family Health Services Appeal Authority Regulations 1995 and to the Health Service Commissioner (Family Health Services Appeal Authority) Order 1995. The Order also makes transitional provisions. This change of name is occasioned by the creation of a new body to be known as the Family Health Services Appeal Authority by the Health and Social Care Act 2001 (c. 15) to discharge specified functions relating to practitioners providing services under Part II of the National Health Services Act 1977 (c. 49).

1977 c. 49, section 11 was amended by paragraph 31 of Schedule 1 to the Health Services Act 1980 (c. 53), by Schedule 10 to the National Health Services and Community Care Act 1990 (c. 19) ("the 1990 Act"), by paragraph 2 of Schedule 1 to the Health Authorities Act 1995 (c. 17) ("the 1995 Act") and by paragraph 6 of Schedule 4 to the Health Act 1999 (c. 8) ("the 1999 Act"); section 126(3) and (4) was amended by the 1990 Act, section 65(2), by the 1995 Act, Schedule 1, paragraph 57, by the National Health Service (Primary Care) Act 1997 (c. 46), Schedule 2, paragraph 27 and by the 1999 Act, Schedule 4, paragraph 37. The functions of the Secretary of State under these provisions are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of the National Assembly for Wales (Transfer of Functions) Order 1999, S.I.1999/672 as amended by section 66(5) of the 1999 Act.back
